HomeMy WebLinkAbout2313 Amends AMC 18.72 ORDINANCE NO. 2313 AN ORDINANCE AMENDING TITLE 18 OF THE ASHLAND MUNICIPAL CODE, THE LAND-USE ORDINANCE, REGULATING THE ESTABLISHMENT OF DRIVE-UP WINDOWS. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. A new section 18.72.105 is hereby added to chapter 18.72 of Title 18, the Land-use Ordinance, estab- lishing regulations relative to drive-up windows, which shall read as follows: "18.72.105 Drive-up uses. Any establishment which by design, physical tacilities, service, or by packaging procedures encourages or permits customers to receive services, obtain goods, or be entertained while remaining in their motor vehicles, shall be subject to the following conditions: A. Drive-up uses may be approved in the C-l (Commercial) zone only. B. Drive-up uses are prohibited in Ashland's Historic Interest Area as defined in the Comprehensive Plan. C. Approval of any drive-up use is subject to the Con- ditional Use procedure of the Land-use Ordinance. D. In addition to the criteria contained in the Con- ditional Use procedure, approvals of drive-up uses are subject to the following criteria: 1. The applicants must demonstrate that the average waiting time in line for each vehicle will not exceed five (5) minutes. Failure to maintain this average waiting time may be grounds for revocation of the approval. 2. All facilities providing drive-up service shall provide at least two (2) designated parking spaces immediately beyond the service window or provide other satisfactory methods to allow customers requiring excessive waiting time to receive service while parked. 3. All drive-up uses shall provide a means of egress for vehicular customers who wish to leave the waiting line. 4. The grade of the stacking area to the drive-up shall either be flat or downhill to eliminate excessive fuel consumption and exhaust during the wait in line. 5. The drive-up shall be designed to provide as much natural ventilation as possible to eliminate the buildup of exhaust gasses. -1- 6. Establishments having drive-ups shall provide sufficient stacking area to ensure that public right-of-ways are not obstructed. 7. The sound level of communications systems shall not exceed 55 decibels at the property line and shall otherwise comply with the Ashland Municipal Code regarding sound levels. 8. The number of new drive-up windows shall not exceed the twelve (12) drive-up windows in exist- ence on July 1, 1984 plus one additional drive-up window for each additional 1,250 persons added to the State-certified population census for the City." SECTION 2. A new subsection L shall be added to Section 18.32.030 of Chapter 18.32 of Title 18, the Land-use Ord- inance and shall read as follows: "L. Drive-up uses as defined and regulated in Section 18.72.105 of this Title."
