ORDINANCE NO. 1762
AN ORDINANCE AMENDING ORDINANCE NO. 1361 WHICH PERTAINED TO THE ZONING
OF THE CITY OF ASHLAND BY AMENDING THE SECTION DEALING WITH AMENDMENTS;
BY PROVIDING FOR THE ZONING OF NEWLY ANNEXED AREAS; AND DECLARING AN
EMERGENCY.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. Section 43 (4) (a) of Ashland Ordinance No. 1361
is hereby amended to read as follows:
"(a) Upon the filing of the Planning Commission's
report with the Councilor upon the expiration of such
ninety (90) days, as aforesaid, the matter shall be set
for public hearing as provided in ORS 227.260."
SECTION 2. Section 8 of Ashland Ordinance No. 1361 is hereby
amended to read as follows:
"SECTION 8. ZONING OF ANNEXED AREAS. Zoning regulations
in effect in an area prior to annexation to the City shall
continue to apply until changed by action of the City. Areas
annexed to the City which are not zoned shall be automatically
classified as R-l:B-lO District unless the zone is established
to the contrary at the time of annexation. Prior to annexation
of land, the procedures set forth in Section 43 hereof may
be followed, including the required public hearings, so that
at the time of annexation and as a part of annexation the
City may also establish the zone for the newly annexed land."
SECTION 3. That inasmuch as it is deemed necessary for the
public health, peace and safety of the citizens of the City of Ashland,
that the provisions shall be made immediately operative, it is hereby
declared that an emergency exists and this Ordinance shall be in full
force and effect from and after its passage by the Council and approval
by the Mayor.
The foregoing Ordinance was first read at a regular meeting
of the Gommon Council held on the 6th day of r'ebruary , 1973, and
passed to its second reading and duly passed on the 20th day of February
1973t the vote being as follows:
