True and Actual Consideration:
PERMANENT BICYCLE AND PEDESTRIAN EASEMENT FOR CITY OF ASHLAND
1. Grant of leasement. The above named Grantors grant to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct,
install, use, operate, inspect, repair, maintain and remove and replace a public
pedestrian ~easement and sidewalk across, along and upon the real property described
below and further referred to in this easement agreement as the "easement area."
The easement area is located in Jackson County, Oregon and is described on the
attached Exhibit A.
2. Use of surface. Grantor shall have the right to use the easement area for all purposes
not inconsistent with the uses and purposes of the property, provided that Grantor shall
not build or erect any structure upon the easement area without the prior written
consent of Grantee.
3. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

ADDITIONAL RIGHT OF WAY DESCRIPTION
LOT 6, BLOCK 4, PATTERSON-PHELPS TRACTS
NORTHWEST CORNER OF LYNN STREET AND HERSEY STREET
A tract of land, being a portion of Lot 6, Block 4 of Patterson-Phelps Tracts in the City of
Ashland, Jackson County, Oregon, according to the official plat thereof, now of record,
and being rnore particularly described as follows:
Beginning at the southeast comer of said Lot 6, from which the southeast comer of
Donation Land Claim No. 41 in Township 39 South, Range 1 East, Willamette Meridian,
Jackson County, Oregon, bears South 890 57' 42" East, 469.99 feet; thence along the
south line of said Lot 6 and the north line of Hersey Street, North 890 57' 42" West (plat
record is \Vest), 9.51 feet; thence 14.93 feet along the arc ofa non-tangent curve which is
concave to the northwest, having a radius of9.50 feet, a central angle of 900 02" 18", and
a long chord which bears North 45001' 09" East, 13.44 feet to the east line of said Lot 6,
being also the west line ofLynn Street; thence along said west line, South, 9.51 feet to
the Point of Beginning.
