PERl\1ANENT UTILITIES EASEMENT FOR CITY OJ' ASHLAND
1. Grant of easernent. The ahove natHed Grantors grant to the City of Ashland, Oregon
"grantee," a perpetual non-exclusive easetnent in gross to construct, reconstruct, instalJ,
use, operate, inspect, repair, 111aintain and remove and replace public utility facilities
including hut not lilHited to, lines for electricity, setver, "vater, gas and
telecomrl1unications on real property described below and further referred to in this
easelnent agreetnent as the "easement area. "
The easell1ent area is located in Jackson County. Oregon, and is described as follows:
See attached Exhibit A.
2. lJse of surface. Grantors shall have the right to use the easement area for all purposes
not inconsistent with the uses and purposes of the property, provided that Grantors shall
not build or place any structure upon the easement area without prior written consent of
grantee.
3. Access to Easenlent Area. Grantee, its agents~ independent contractors and iuvitees
shal1 have the right of ingress and egress to the easerl1ent area fro the purposes connected
with this easement.
4. N~)tice. Grantee, its agents~ independent contractors and invitees shall, upon every
occasion that such public utility facilities are constructed, maintained, replaced,
reconstructed or removed, provide Grantors reasonable notice and restore the premises of
the Grantors, and any buildings or irnprovements disturbed by Grantee, as near as
practicable.
5. Tennlnation. AJI rights hereunder shall cease if and when the easelnent area ceases to
be used for public utility purposes.
6. I~!i91' EncU1nbran~es. This easement 1S granted subject to all pnor easements or
encmnbrances of record.
