HomeMy WebLinkAbout1278 Amends Zoning ORD ORDINANCE NO. 1278 An ordinance amending Section 3 of Ordinance No. 1261, the zoning ordinance of the City of Ashland, to provide that in Zone No.3, Residential District, there shall be permitted only single family dwellings, public buildings and schools. WHEREAS, the Common Council contemplates the emplo~~ent of a planning expert who shall have as one of his duties the submitting of recommendations concerning the revision of the zoning laws of the City of Ashland, and \VHEREAS, at present under Ordinance No. 1261 there is only one residential district, and WHEREAS, the Common Council contemplates, after recE~iving the reccmmendations of the planning consultant, to rezone the single residential district into various residential districts of different grac.es and character, and 1~1EREAS, it is the opinion of the Common Council that to and until the residential areas are rezoned into various residential districts, the definition of Residential District as provided in Section 3 of Ordinance No. 1261 should be made more restrictive, NOW, THEREFORE, THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: Section 1. That Section .3 of Ordinance No. 1261 be, and the same hereby is, amended as follows: IISection 3. The regulations and restrictions applicable to the various zones shall be as follows: Zonl2 No.1: That in Zone No.1, Business District, there shall only be permitted the uses specified in Zone No.3, together with wholesale and retail business, armories, garages, service stations providing t:hat grease racks and tire repairing are performed ~lithin an enclosed building, theaters, banks, newspaper and printing plants, shops, professional offices, insurance and real estate offices, restaurants, hotels, nlotels, churches, multiple dwellings and apartments. -1- Zone No.2: That in Zone No.2, Industrial District, there shall be permitted all the uses of Zones land 3, together with factories, mills, manufacturing, wrecking yards, wood yards, boiler works, canneries, packing houses, junk yards, and gasoline distributing plants or wholesale stations. Zone No.3: That in Zone No.3, Residential District, there shall be permitted only single family dwellings, public buildings and schools. In the event any dispute shall arise as to permitted use in any zone, such dispute shall be determined by the Common Council, after recommendation by the Planning Commission. II Section 2. That inasmuch as it is necessary in order to carry out the intent of the foregoing ordinance to immediately prevent applica.tions for use of land in Zone No.3, Residential District, other than a.s permitted undir the foregoing ordinance provisions, it is hereby deemed necessary for the public peace, health and safety of the citizens of the City of Ashland that an emergency be, and the same is hereby, declared to exist, and this ordinance shall be in full force and effect fronl and after its passage by the Council and approval by the Mayor.
