HomeMy WebLinkAbout1293 Amends Zoning ORD ORDINANCE NO. 1293 An ordinance amending Ordinance No. 1261, the zoning ordinance of the City of Ashland, by the addition of a new zone designated as zone No.4, Low Density Residential District, and designating uses permitted therein, amending uses permitted in Zone No.3, Residential District limiting lot size for residential construction, amending Section 11 with regard to automobile parking spaces for certain buildings, and declaring an emergency. THE PEOPLE OF THE CITY OF ASHLAND DO ORDP"IN ,AS FOLLOWS: Section 1. That Section 2 (c) of Ordinance No. 1261 be, and the same hereby is, amended to read as follows: II (c) ZONE NO.4. Low Density Residential District, described as follows: All areas wi1:hin the City of Ashland not included in Zone No.1, Zone No. 2 and Zone No.3, and all areas hereafter annexed to the city of J~shland. II Section 2. That Section 2 of Ordinance No. 1261 be, and the same is hereby, amerded by the addition of the following provision: "(d) ZONE NO.3. Residential District, described as follows: parcell: Beginning at the intersection of the westerly line of North Main street with the Northerly line of Wimer Street in the City of Ashland, Jackson County, Oregon; thence along said Northerly line of Wimer street 200 feet to the true point of-beginning: thence continue West along said Northerly line to a point 350 feet West of the intersection of the Westerly line of Chestnut Street and the North line of Wimer street; thence North 273 feet to a point on the North line of Luna Vista Street; thence West along said North line of I.luna Vista Street to a point 240 feet West of the West line of Chestnut Street; thence North and parallel to Chestnut Street to the South line of Wiley street; thence East along said South line of Wiley Street to a point on the East line of Chestnut Street, said point being 264 feet from the North line of Maple street; thence East and parallel to Maple Street to a point 200 feet West of the westerly line of North Main Street (measured at right angles to North Main Street): thence Southeasterly and parallel to North Main Street to the North line of 't,oJimer Street, the true point of beginning. Parcel 2: Beginning at the intersection of the East line of High street and the Southerly line of Wimer Street in the City -1- of Ashland, J'ackson County, Oregon; thenCE! Parcel 5. Be~ginning at a point on the West line of Walker Avenue in the~ City of Ashland, Jackson County, Oregon, said point being 150 feet South of the intersection of said West line with the Southerly line of Siskiyou Boulevard; thence continue South along said West line of Walker Avenue to a point 149 feet South of the South line of Oregon Street; thence West and parallel to Oregon Street to the East line of Frances Lane; thence North along said East line of Frances Lane extended to a point 150 feet South of the Southerly line of Siskiyou Boulevard; thence Easterly and parallel to said Southerly line of Siskiyou Boulevard to the point of beginning. ~/~~~~~ II Section 3. That the description of the uses permittE~d in Zone No. 3 as provided in Secti.on 3 of Ordinance No. 1261 bE~, and the same hereby is, amended to re~ad as follows: "Zone No.3: That in Zone No.3, RE~S idential District, there shall only be permitted single-famlly dwellings with lot limitations as hereinafter provided therefor in Zone No. 4, multiple family dwellings including apartment houses, and the conditional uses as hereinafter provi.ded." Section 4. That Section 3 of Ordinance No. 1261 be, and the same hereby is, amended by the addition of the following provision: "Zone No.4: That in Zone No.4, Low Density Residential District, there shall only be permitted single-family dwellings and the conditional uses as hereinafter provided. A single- family dwelling is a detached building designed and used exclusively for occupancy by one (l) family. The minimum lot area for all structures in Zone No.4 shall be 6,000 square feet and shall front on a street. A lot having an area of less than 6,000 square feet of record at the time of the passage of this ordinance may be occupied by one single-family dwelling provided all of the yard requirements are complied with. When application of the lot size requirements would cause undue hardship to a property owner, the Planning Commis- sion shall have the right to waive the same. II Section 5. That Ordinance No. 1261 be, and the same hereby is, amended by the addition of a section to be known as Section 3A as follows: "Section 3A Churches, schools, governmental structures such as libraries or fire stations, or public utilities may be allowed in Zone No. 3 and Zone No. 4 and, in addition thereto, hospitals, institutional homes and professional buildings may be allowed in Zone No.3. The uses hereinabove enumE~rated are conditional uses, and pla,ns and specifications accompanied by a petition requesting such use shall be first submitt:ed to the Ashland Planning Commission for approval. The Commission in reviewing plans and specifications may consider the most appropriate use -4- of the land: the conservation and stabilization of the value of property; adequate open space for light and air: concentra- tion of population: congestion of public streets; the promotion of the public safety, health, convenience, and comfort; and the general welfare of the persons residi.ng or working in the neighborhood of such use. In addition to the nonnal require- ments of the zone, the distance of the structure from the property side line shall be increased one foot for every 2 feet in height in excess of 25 feet. Signs shall be non- illuminated or indirectly illuminated, shall not exceed 12 square feet and shall be limited to one per side abutting a street, except that the regulation for signs for professional buildings Sheill be limited by Section 4 of this ordinance. The planning Commission may also require 'that the following conditions b~~ met: controlling the location and nwnber of vehicular access points to the property; and requiring screen- ing and landscaping where necessary. II Section 6. That the provisions of Section 9 of Ordinance No. 1261 apper- taining to set-back lines in Zone No. 3 are hereby adopted and also applicable to Zone No.4. Section 7. That Section 10 of Ordinance No. 1261 be, and the same hereby is, amended to reaLd as follows: "Section 10. That no residence or building shall l)e constructed in Zone No. 3, B~sidential District, closer than four (4) feet from any property side-line, except that t.his section shall not be applicable to the street side-line which is heretofore -5- regulated and shall not be applicable to side-lines running along an alley. That no residence or building shall be constructed in Zone No.4, Low Density Residential District, closer than four (4) feet from any property side-line for lots having less than 60 feet of width, or six (6) feet from any property side-line for lots having 60 feet or more of width. This section shall not be applicable to the st:reet side-line which is heretofore regulated and shall not be applicable to the side-line running along an alley. II Section 8. That that portion of Section 11 of Ordinance No. 1261 desig- nating the number of car spaces for multiple dwellings and that portion providing for the number of parking spaces for churches, auditoriums, stadiums, theaters, clubs, high schools, educational institutions, and similar places of assembly, be, and they hereby are, amended as follows: IIMULTIPLE DWELLINGS: One car space for each apartment or living unit. II "CHURCHES, AUDITORIUMS, STADIUMS, THEATERS, CLUBS, HIGH SCHOOLS, EDUCATIONAL INSTITUTIONS, AND SIMILAR PLACES OF ASSEMBLY: One parking space for every four (4) seats pro- vided in said building, auditorium, or assembly room. II Section 9. That in view of the fact that zoning ordinance No. 1261 as amended permits only single-family dwellings in the Residential District and has no provision for a multiple family residential district, and the amendment so providing was passed as a stopgap amendment and has curtailed construction in certain areas, it is deemed necessary for the public peace, health and safety of the people of the City of Ashland that an emergency be, and the same -6- is hereby, declared to exist and this ordinanc€~ shall be in full force and effect from and after its passage by the Council and approval by the Mayor. The foregoing ordinance was duly passed, under a suspension of the rules, at a regular meeting of the Common Council held on the /{ day of ,~~-, 1961, the vote being as follows: Ayes ,. .
