ORDINANCE NO. 1298
An ordinance amending Ordinance No. 1261 as amended, the zoning
ordinance of the City of Ashland, by the addition of a new section
to be known as Section 3B which shall permit the excavation of sand,
gravel and other earth products in all zones as a conditional use,
and providing for standards which can be established by the Planning
Commission in granting such conditional use.
THE PEOPI_,::; OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
Section 1.
That Ordinance No. 1261 be, and the same hc=reby is, amended
by the addition of a section to be known as Sec1tion 3B as follows:
"Section 3B.
The excavation and removal of sand, gravel, stone,
loam, dirt, or other earth products may be allowed in all
zones as a conditional use, it being understood that the
restri('tions of this section shall not be a.,pplicable to

of 9x.'lHle of property for the construction of improvement.s
thereon. Plans and specifications accompanied by a pet.it.ion
requesting such use shall be first submitted to the Asnland
Planning Commission for approval. Plans and specifications
ffi\tSt show location of premises, grading plan, existing and
proposed drainage, proposed truck access, and details of
regrading and revegetation of site. The excavation and
removal of gravel shall be carried out according to the plan
as submitted and approved by the Planning Commission. Any
deviation from the plan will serve to revoke the permit.
The Commission in reviewing plans and specifications
may consider i:he most appropriate use of the land, setback
from the property and street line, the protection of pedes-
trians and vehicles, the prevention of the collection and
stagnation of water at all stages of the operation, and the
rehabilitation of the land upon termination of the operation,

and shall have the right to require a bond to insure
performance."
The foregoin~J ordinance was duly passed, under a suspension
of the rules, at Cl regular meeting of the Common Council held on
