Calle Guanajuato Overlook Mosaic project Total $3,000.00 CITY OF ASHLAND AGREEMENT FOR THE CREATION AND TRANSFER OF A WORK OF ART This Agreement is between the City of Ashland, ("CITY") and Susan Springer, ("ARTIST") effective as of February 1, 2005. RECITALS: A. CITY acts to create work of art inion city-owned property. B. ARTIST has been selected to create AGREEMENT: A. ARTIST shall prepare WORK in accordance with the Request for Proposal attached as Exhibit !. B. ARTIST shall provide CITY with scale design, full color rendering and working drawings. EFFECTIVE DATE This agreement shall be effective as of the above date. Artist agrees to complete the work no later than the 15 day of February 2005. COMPENSATION Compensation is $3,000 for the work. OWNERSHIP OF WORK/COPYRIGHT A. OWNERSHIP The WORK created under this agreement shall be the property of the CITY. B. COPYRIGHT The ARTIST shall retain copyright, but shall make no exact duplications to full scale of the WORK at another location. All copyright and further reproduction rights to the WORK shall remain with the ARTIST. C. PROTECTION OF COPYRIGHT City UNDERSTANDS that the copyright to the WORK remains with ARTIST and that the copyright is not transferred to the CITY unless otherwise stated in writing by ARTIST. The CITY is not liable for third party violation of the copyright. D. COPYRIGHT CLAIMS ARTIST hereby agrees that ARTIST shall give CITY written notice prior to asserting any claim pertaining to the specific WORK referenced herein which may arise pursuant to 17 V.S.C. S101 et seq. (the "Copyright Law") including but not limited to 17 V.S.C. 106A (E) the Visual Artists' Rights Act. E. ARTIST acknowledges that CITY shall have the right to have manufactured and installed on the overlook of the Calle Guanajuato staircase. REPRODUCTIONS The ARTIST shall allow the CITY to make and authorize the making of photographs and other two-dimensional reproductions of the WORK. for educational, public relations, arts promotional and other limited commercial purposes for as long as the CITY owns the work. On any such reproductions, the CITY will acknowledge the ARTIST's authorship and provide copyright notification in compliance with the U.S. copyright law. In the event CITY wishes to use WORK. for commercial purposes, CITY shall contact ARTIST so that a separate agreement may be negotiated. CREDITS The ARTIST also agrees that photographic reproductions of the WORK. made by ARTIST for publicity purposes shall refer to the fact that the WORK. is installed at the Calle Guanajuato staircase under the CITY OF ASHLAND, OREGON Public Art Program. WARRANTY, LOSS OR DAMAGE ARTIST warrants that the work is and will be the original product of ARTIST'S own creative efforts and does not infringe on any third party's copyrights or other intellectual property rights. The Stairway project is the final piece in a flood restoration project that ultimately will include three op- portunities for public art: Phase I: Calle Overlook Phase II: Sculpture Garden &Wall Niche Phase III: Stairway Railing Panel Inserts HISTORY Water has always played an important role in Ashland's history, from the location of the first mill beside Ashland Creek, to the discovery of the curative powers of 'Lithia Water' that first brought tourists to the town. Ashland Creek runs through Lithia Park, which replaced the mill and serves as the city's outdoor 'living room,' and behind the businesses on the downtown Plaza, which is the center of the city's civic life and still-thriving tourism trade, Historically, Ashland's commitment to culture and the arts was exemplified first by the Chautauqua Society and then the Oregon Shakespeare Festival, which has been located next to Lithia Park since 1935. Calle Guanajuato is an important pedestrian walkway located next to the Park and behind the Plaza that honors both the natural beauty of Ashland Creek and Ashland's ongoing sister-city relationship with Guanajuato, Mexico. Calle Guanajuato suffered substantial damage in the New Year's Day Flood of 1997, which also ravaged Lithia Park, the Plaza, and many other parts of the city. The Calle Guanajuato Restoration Project is the last piece in the overall renovation to the flood-damaged area. VISION From the beginning the Calle Guanajuato Restoration Project has been about water. In response to the 1997 flood, the community of Ashland, under the guiding leadership of the Ashland Parks Department, focused atten- tion on the destructive power of water. As a result of this process, the community built a stone wall in Lithia Park to redirect flood waters back into the stream channel, away from downtown and the front lawn of Lithia Park. A new bridge over Windburn Way was constructed with wing walls to further direct floodwaters. Walls were extended along Calle Guanajuato and the new footbridge was raised above the 100-year flood mark. All of this was done with great attention to detail, with the final result a beautiful enhancement to Ashland Parks. The Calle Guanajuato Restoration Project continues with the opportunity to explore the beauty and wonders of water through art. Earth is the rare jewel within the vastness of space, where the abundance of water allows for life as we know it. Out of this abundance has grown industry, art, poetry, myth, and the myriad of creatures living in the water and at the water's edge. It is from this life and our shared creative legacy that the Calle Guanajuato project draws inspiration, celebrating the miracle of water. The project is further enriched by the participation of our sister city Guanajuato, Mexico. Each community, Ashland and Guanajuato, has a strong commitment to the Arts and a tradition of cultural exchange spanning 35 years. Calle Guanajuato Phase I RFP page 1 of 7 . The winning entry will dearly incorporate and reflect the theme, a celebration of water and the community ties with Guanajuato. Through this Request For Proposal, it is hoped that the insights of each community will raise the awareness of us all. DESCRIPTION The Calle Stairway Overlook is approximately 645 square feet and is located at the top of the newly constructed stairway. The Overlook is a level walking space, is accessed from the public sidewalk on Granite Street and includes an existing storm drain (see attached Site Plan). Since both the stairway and the overlook are public spaces, safety and durability are both high priorities. The winning entry must clearly demonstrate its appropriateness for outdoor use in Ashland's climate and incorporate the drain as shown in the plan. This site is located in a public right of way and is subject to the standards and specification of sidewalk construction. All materials other than Portland cement concrete must be approved by the city council. The materials must be permanently installed and must provide a level-walking surface that complies with the handicapped accessibility requirements of the Americans with Disabili- ties Act (ADA) and must comply with local installation standards for installation, surface condition, weather condi- tions etc. and meet the approval of the City of Ashland Public Works Department. The site is basically flat and is bordered by Granite Street on the east and by the Stairway on the west. There is a large Douglas fir tree in the overlook footprint (see photos). The overlook affords very nice views of Ashland Creek and the Calle Guanajuato to the west (see photos). Behind the overlook to the east is an established residential neighborhood. The west side of the overlook will be enclosed by a low wall or railing for safety. Calle Stairway Description The exposed aggregate paving for the steps will be installed with integral color in the concrete (Davis Color 'Sandstone' #5237), IA" granite aggregate chips. All lower landings will be IA" granite chips. The walls on the stair- case will be colored concrete to match walls along Ashland Creek. The artist/artist team may approach this project in one of two ways: 1) Entrants may submit a design concept to be fabricated and installed by others. For artists choosing to submit design only, please note that the installation material is either Portland cement concrete or mosaic tile subject to the approval of the city council. 2) Entrants may submit a design concept and specifY materials and installation. BUDGET $3,000 for the design. Installation fees to be detennined based on proposal from artist or artist team. As of the writing of this document, the project budget is being refined, and fundraising still ongoing. The Public Arts Commission reserves the right to cancel or amend any or all of the budgets referenced in this document subject to successful fundraising. TIMELlNE The schedule is contingent upon the City's project schedule and may be changed at any time. Calle Guanajuato Phase I RFP page 2 of7 EL1GIBILlTY This Request For Proposals is open to all professional artists residing or working either in Jackson County, Or- egon or in Guanajuato, GTO Mexico. Entrants may be individuals or artist teams, but at least one team member must meet this residency requirement. SUBMISSIONS All materials must be received in the City of Ashland Public Arts Commission office by 5:00 :P.M., Friday, October 29, 2004. Graphic Rendition of your design concept, including at a minimum: Site Plan, Enlarged Plan, and other render- ings or details as required to explain the design. 4. Photographs up to ten prints, slides or digital images of previous work or related projects, accompanied by a sheet with descriptions of each work sample. 5. Biographical information, including previous experience, for all team members (limit one page per team member). 6. Proof of Residency in Jackson County or Guanajuato, GTO Mexico. 7. Include a self-addressed stamped envelope if you wish return of your materials. 8. The name(s) and contact information of person(s) who will be responsible for the project with a description of each person's experience in performing the type of services being requested Artist submitting both design and materials and installation must also include: 9. List of Materials and Installation Guidelines, including step-by-step process for installation. 10. Proposed Budget for Fabrication and Installation INSURANCE For artist/teams who will provide the material and install the work: The selected artist/team and or installation team is required to carry professional liability insurance of no less than $500,000 with a maximum deductible of $5,000.00 SELECTION COMMITTEE The winning entry will be selected by a Selection Committee consisting of seven people, including one rep- resentative each from the Ashland Parks and Recreation Department, the Ashland Public Works Department, the Landscape Architect responsible for the project, the Lithia Arts Guild, a resident of the neighborhood, a business owner on the Plaza, and a member of the community at large. A member of the Public Arts Commission will facilitate the jury process but will not cast a vote. Response to project theme "A Celebration of Water" 3. Response to cross-cultural exchange/sister city relationship with Guanajuato 4. Artistic excellence and innovation 5. Entrant track record on similar projects For artists submitting design and specify materials and installation the following criteria applies: 1. Appropriateness of the artwork to site in terms of scale, form, content and materials 2. Appropriateness of design solution for the climate and site 3. Appropriateness and availability of materials specified 4. Dependability of artwork relative to theft, vandalism and the environment 5.
