PERMANENT UTiliTIES EASEMENT
1. Grant of easement. The above named Grantors grant to the above named Grantee a
perpetual non-exclusive easement to construct, reconstruct, install, use, operate,
inspect, repair, maintain and remove and replace utility facilities including but not limited
to, lines for electricity, sewer, water, gas and telecommunications on real property
described on the attached Exhibit A and further referred to in this easement agreement
as the "easement area."
The easement area is located in Jackson County, Oregon, and is described on the
attached Exhibit A.
2. Use of surface. Grantors shall have the right to use the easement area for all
purposes not inconsistent with the uses and purposes of the property, provided that
Grantors shall not build or place any structure upon the easement area without the prior
written consent of Grantees.
3. Access to Easement Area. Grantees, their agents, independent contractors and
invitees shall have the right of ingress and egress to the easement area for the
purposes connected with this easement.
4. Notice. Grantees, their agents, independent contractors and invitees shall, upon
every occasion that such utility facilities are constructed, maintained, replaced,
reconstructed, or removed, provide Grantors reasonable notice prior to entry and
restore the premises of the Grantors, and any buildings or improvements disturbed by
Grantees, as near as practicable.
5. Prior Encumbrances. This easement is granted subject to all prior easemHnts or
encumbrances of record.

PUBLIC UTILITY EASEMENT
A strip of land, lying across a portion of the Southeast Quarter of Section 11 in Township
39 South, Range 1 East of the Willamette Meridian in Jackson County, OregoIll and being
more particularly described as follows:
Commencing at the most southerly comer of that certain parcel of land described in
Document No. 97-24726, Official Records, Jackson County, Oregon, from whilch.the
comer common to Sections 11, 12, 13 and 14 of said Township and Range bears South
150 22' 45" East, 400.60 feet; thence along the southeasterly line of said parcel, North
500 28' 00" East, 8.32 feet to the Point of Beginning; thence North 380 09' 29" West,
210.06 feet to the northwesterly line of said parcel; thence along said northwesterly line,
North 500 28' 00" East, 10.00 feet; thence South 380 09' 29" East, 210.06 feet to the
southeasterly line of said parcel; thence along said southeasterly line, South 500 28' 00
West, 10.00 feet to the Point of Beginning.
