PERMANENT UTILITIES EASEMENT
1. Grant of easement. The above named Grantors grant to the above named Grantee a
perpetual non-exclusive easement to construct, reconstruct, install, use, operate,
inspect, repair, maintain and remove and replace utility facilities including but not limited
to, lines for electricity, sewer, water, gas and telecommunications on real property
described on the attached Exhibits A and B and further referred to in this easement
agreement as the "easement area."
The easement area is located in Jackson County, Oregon, and is described on the
attached Exhibits A and B.
2. Use of surface. Grantors shall have the right to use the easement area for all
purposes not inconsistent with the uses and purposes of the property, provided that
Grantors shall not build or place any structure upon the easement area without the prior
written consent of Grantees.
3. Access to Easement Area. Grantees, their agents, independent contractors and
invitees shall have the right of ingress and egress to the easement area for the
purposes connected with this easement.
4. Notice. Grantees, their agents, independent contractors and invitees shall, upon
every occasion that such utility facilities are constructed, maintained, replaced,
reconstructed, or removed, provide Grantors reasonable notice prior to entry and
restore the premises of the Grantors, and any buildings or improvements disturbed by
Grantees, as near as practicable.

5. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

A 25 foot wide easement lying 12.5 feet on each side of the following described
centerline:
Commencing at the northwest comer of Lot 1 of the plat of Terrace Pines
Subdivision in the City of Ashland, Jackson County, Oregon, now of record;
thence along the northerly line of said Lot I, South 88033'57" East (cited as North
89055'49" East on said plat), 79.55 feet to the westerly line of Terrace Street;
thence along said westerly line, North 16005'48" East (cited as North 14035'34"
East on said plat), 13.87 feet to the Point of Beginning of the centerline herein
described; thence leaving said westerly line, North 89012'08" West, 223.28 feet;
thence South 57025'27" West, 149.87 feet; thence South 57008'22" West, 37.99
feet; thence South 66006'56" West, 16.36 feet; thence North 70007'53" West,
91.95 feet; thence North 73026'58" West, 194.64 feet; thence North 76008'15"
West, 27.02 feet; thence North 83015'28" West, 20.56 feet; thence North
89018'25" West, 17.97 feet; thence South 50026'27" West, 15.34 feet to a point on
the westerly line of the NE 1/4 of the SW1/4 of the NW1/4 of Section 16,
