True and Actual Consideration:
PERMANENT UTILITY AND PEDESTRIAN EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantor grants to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct,
install, use, operate, inspect, repair, maintain and remove and replace public utilities a
public pedestrian easement and sidewalk across, along and upon the real property
described below and further referred to in this easement agreement as the "easement
area."
The easement area is located in Jackson County, Oregon and is described on the
attached Exhibit A.
2. Use of surface. Grantor shall have the right to use the easement area for all purposes
not inconsistent with the uses and purposes of the property, provided that Grantor shall
not build or erect any structure upon the easement area without the prior wriitten
consent of Grantee.
3. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

SIDEWALK EASEMENT
DE BAY PROPERTY
A 3.00 foot wide easement across a portion of that real property described in I)ocument
Number 80-14720, of the Official Records of Jackson County, Oregon, being located in
the Southwest One-quarter of Section 14, Township 39 South, Range 1 East of the
Willamette Meridian, in the City of Ashland, Jackson County, Oregon, and more
particularly described as follows:
Beginning at a point on the easterly boundary of said document, also being a point on the
westerly right of way of Tolman Creek Road, being North 00002'19" West, 81.98 feet
from the southeast comer thereof; thence continuing along said boundary and right of
way, North 00002'19" West, 61.77 feet; thence leaving said boundary and right of way;
South 89057'41" West, 3.00 feet; thence parallel with said right of way, South 00002'19"
East, 61.77 feet; thence North 89057'41" East, 3.00 feet to the Point of Beginning.
Containing 185 square feet, more or less.
The sidelines of this easement are to be prolonged or shortened as to meet at angle points,
to begin at a point on the easterly boundary of aforementioned document, also being a
point on the westerly right of way of Tolman Creek Road, be 61.77 feet in length along
said boundary, and to be 3.00 feet in width.
Basis of description is the centerline monuments tied or set by Survey Number 16604, as
filed in the office of the Jackson County Surveyor.
