Brown, Director of Public Works City of Ashland 20 East Main Ashland, Oregon 97520 Dear Ms. Brown: This letter concerns our continuing cooperative data collection program for Federal fiscal year 2005 (October 1,2004, to September 30, 2005). Total costs to continue the program for Federal fiscal year 2005 will be $50,640. The City of Ashland's share is $31,120. The U.S.. Geological Survey will provide $19,520 of Federal Matching Funds to support this work. A summary of the data collection sites and their associated costs is enclosed. The addition to this year's program is the monthly seasonal sampling (May -- October) in the vicinity of the Mt. Ashland ski area. Cost to measure seven sites monthly for discharge, water temperature, specific conductance, pH and suspended sedhnent (plus turbidity on East Fork Ashland) will be $11,600. This does not include any oil & gas residue sampling from the parking area. For that work, we will have a proposal for you concerning the technique and related costs prior to the May sampling. In past years, the U.S. Geological Survey has continued ongoing data collection and interpretive project work with the verbal understanding that an interagency agreement would be forthcoming. The signed agreement is our legal authority that permits the work to be performed and which authorizes USGS to accept funds. We recognize the critical nature of the long-term, continuous record data and focused investigations that the USGS provides to both your agency and to the Federal government. The data networks and investigations provide valuable information that is used to manage and preserve natural resources throughout the Nation. Attached are two original copies of a Joint Funding Agreement (JFA) to confirm our negotiations to continue this data collection program. Please sign both originals; return one signed original in the enclosed self-addressed envelope and retain the other original for your records. Ms. Paula C. Brown 2 In order to provide your agency with continuous data and research beyond February 27, 2005, the enclosed JFA must be signed and received in this office no later than February 27, 2005. Funds are not required at this time; a signed agreenlent is not a bill, only an agreement to pay for the work that will be done. The City of Ashland will be billed quarterly during the Federal fiscal year, via a DI-1040, Bill for Collection, unless a written request for a different billing cycle is received with the JF A. Work performed with funds from this agreement will be conducted on a fixed-price basis. The results of all work under this agreement will be available for publication by the U.S. Geological Survey. The parties hereto agree that subject to availability of appropriations and in accordance with their respective authorities there shall be maintained in cooperation a water resources investigation program in the Ashland, Oregon area herein called the program. 2. The following amounts shall be contributed to cover all of the cost of the necessary field and analytical work directly related to this program. (a) $19,520 by the party of the first part during the period October 1, 2004 to October 31, 2005 $31,120 by the party of the second part during the period October 1, 2004 to October 31, 2005 (b) (c) Additional or reduced amounts by each party during the above period or succeeding periods as may be determined by mutual agreement and set forth in an exchange of letters between the parties. 3. The costs of this program may be paid by either party in conformity with the laws and regulations respectively govmning each party. 4. The field and analytical work pertaining to this program shall be under the direction of or subject to periodic rEiview by an authorized representative of the party of the first part. 5. The areas to be included in the program shall be determined by mutual agreement between the parties hemto or their authorized representatives. The methods employed in the field and office shall be those adopted by the party of the first part to insure the required standards of accuracy subject to modification by mutual agreement. 6. During the course of this program, all field and analytical work of either party pertaining to this program shall be open to the inspection of the other party, and if the work is not being carried on in a mutually satisfactory manner, either party may terminate this agreement upon 60 days written notice to the other party. 7. The original records resulting from this program will be deposited in the office of origin of those records. .Upon request, copies of the original records will be provided to the office of the other party. 8. The maps, records, or reports resulting from this program shall be made available to the public as promptly as possible. The maps, records, or reports normally will be published by the party of the first part. However, the party of the second part reserves the right to publish the results of this program and, if already published by the party of the first part shall, upon request, be furnished by the party of the first part, at costs, impressions suitable for purposes of reproduction similar to that for which the original copy was prepared. The maps, records, or reports published by either party shall contain a statement of the cooperative relations between the parties. 9. Billing for this agreement will be rendered quarterly. Payments of bills are due within 60 days after the billing datj~. If not paid by the due date, interest will be charged at the current Treasury rate for each 30 day period, or portion thereof, that the payment is delayed beyond the due date.
