CONDITIONS, COVENANTS & RESTRICTIONS Redco Development, LLC, a limited liability company, Owner, hereby covenc:lnts that the following conditions and restrictions for the benefit of the City of Ashland, On~gon, apply to the real property described as: Parcel 1: Parcel 1 of partition Plat P-21-1999, recorded March 31, 1999, under County Surveyor File No. 16096, in Jackson County, Oregon. Parcel 2: Parcel No.2, as shown on the partition plat filed in the office of the Jackson County surveyor as No. 15245 and recorded as Partition Plat No. P-1-1997, of "Record of Partition Plats," in Jackson County, Oregon. Said parcels shall collectively hereinafter be referred to as the "Burdened Property. " Any structures built upon the burdened property shall be built in accordance with and subject to the Solar Access Standards set forth in Ashland Land Use Ordinance Section 18.70.040 A., as it exists on the date hereof. Any request for a Variance to this standard shall be subject to Ashland Land Use Ordinance Section 18.70.060, as it exists on the date hereof. This covenant shall be perpetual, shall run with the land and shall be binding upon Owner, his heirs, successors and/or assigns. Except in accordance with the variance proceduies as set forth above, this covenant may only be waived or modified if Ashland Land Use Ordinance Section 18.70, as it exists on the date hereof, is itself modified by the City of Ashland under the procedures specified for legislative amendments to its Land Use Ordinances.
