As owner of the property listed above, I hereby consent to the following improvements, dedication, or other actions as
required by the City of Ashland, and agree to bear the proportionate payment of associated costs. This Agreement is
to be binding upon myself/ourselves, my/our heir(s), executors, and assigns, and it is my/our express intention that
this Agreement shall run with the land, so that fulfillment of the items listed below shall be binding upon future owners
of the property.
Action: The owner shall not install kitchen facilities into the basement. The existing property contains only one
single family residence and the new home's basement will not be utilized as a separatl~ residential unit. A
separate, second residential unit is not permitted without obtaining a conditional USie permit approval,
and therefore us f the space as a separate dwelling would be a violation of the Ashlcmd Municipal Code
and subject t I penal . s thereof.

Commencing at the INITIAL POINT of Mann Subdivision to the City of
Ashland, as now recorded, being situated in Southeast Quarter of
Section 5, Township 39 South, Range 1 East of the Willamette Base and
Meridian, Jackson County, Oregon;
THENCE South 00 degrees 04 minutes 10 seconds East for a distance
of 92.50 feet to the Northeast corner of Lot 6 of said Subdivision, as
now recorded;
THENCE South 89 degrees 36 minutes 30 seconds West along the
boundary line common to Lots 1 and 6 of the Mann Subdivision, as now
recorded, for a distance of 64.295 feet to the corner common to Piircels
No. 1 and 2 of that "NINOR LAND PM~TI'l'tON" filed f,.,r record the 19th

No. 8609, said common corner being the TRUE POINT OF BEGINNING:
THENCE continuing South 89 degrees 36 minutes 30 seconds West
along the common boundary line of Lot 1, 2 and 6 of said subdivis:lon
for a distance of 64.295 feet to a 5/8 inch iron rod situated at the
Northwest corner of Parcel No. 1 of the hereinabove referred to M:lnor
Land Partition;
THENCE South 00 degrees 32 minutes 30 seconds East along the
boundary line common to Lots 4, 5 and 6 of said subdivision for a
distance of 107.47 feet to a 5/8 inch iron rod WITNESS MONUMENT;
THENCE continuing South 00 degrees 32 minutes 30 seconds East
along the boundary line common to Lots 5 and 6 of said subdivision for
a distance of 20.00 feet to a 5/8 inch iron rod situated at the
Southwest corner of Lot 6 of said subdivision and the Southwest corner

THENCE North 89 degrees 55 minutes 50 seconds East along said
right of way line, which is common ~o the Southerly boundary line of
Lot 6 of said subdivision, for a distance of 63.77 feet to a 5/8 J,nch
iron rod situated at the corner common to Parcels No. 1 and 2 of that
MINOR LAND PARTITION filed for record the 19th day of November 1900 and
recorded in Volume 3 at Page 79 of "MINOR LAND PARTITIONS" in Jackson
County, Oregoni
THENCE leaving said right of way line North 00 degrees 18 minutes
20 seconds West along the boundary line common to Parcels No. 1 and 2
of said MINOR LAND PARTITION for a distance of 127.83 feet to the point
of beginning.
Subject to the 20 foot utility and street slope easement and those
conditions as set forth in the DEDICATION of that MINOR LAND PARTITION
filed for record the 19th day of November 1980 and recorded in Volume 3
at Page 79 of "MINOR LAND PARTITIONS" in Jackson County, Oregon.
