PUBLIC PARKING AND PEDESTRIAN EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantor grants to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct,
install, use, operate, inspect, repair, maintain and remove and replace a public parking
facility and sidewalk across, along and upon the real property described below and
further referred to in this easement agreement as the "easement area."
The easement area is located in Jackson County, Oregon and is described on the
attached Exhibit A.
2. Use of surface. Grantor shall have the right to use the easement area for all purposes
not inconsistent with the uses and purposes of the property, provided that Grantor shall
not build or erect any structure upon the easement area without the prior written
consent of Grantee.
3. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

EASEMENT DESCRIPTION
Commencing at a point 422.5 feet North and 675.0 feet West of the northwest corner of
Donation Land Claim No. 42, located within Section 4, Township 39 South, Range 1 East of
the Willamette Meridian in the City of Ashland, Jackson County, Oregon, said point also
being the intersection of the southerly right of way line of Hersey Street with the westerly right
of way line of Helman Street in said City; thence South 250 35' West, along the westerly right
of way of said Helman Street, a distance of 255.0 feet; thence North 630 45' West, 11.00 feet;
thence North 250 35' East, 255.0 feet to the southerly right of way line of said Hersey Street;
thence South 630 45' East, along said southerly right of way line 11.00 feet to the point of
beginning.
