City and Contractor agree: 1. Contract Documents: This contract is made as a result of an Invitation to Bid issued by City entitled "INVITATION TO BID" for a HYDRAULIC EXCAVATOR, Bid No. #2006-107, Contractor was awarded the bid as the lowest responsible bidder on 01/11/2007. In the event of any inconsistencies in the terms of this contract, the contract documents defined in the invitation to bid and Contractor's bid, this contract shall take precedence over the contract documents which shall take precedence over the bid. 2. Scope: Contractor shall produce and deliver the equipment described in the contract documents within the time prescribed in the contract documents. Morrison Excavator Purchase We received the bids for the mini excavator. The lowest cost unit that meets our specifications was received from Central Equipment; they bid a Kubota model number KX-161-3R4AS. This is the second lowest priced bid we received but the lowest that meets our specifications. The unit bid by Pape Material Handling Inc. came in at a lower price but did not meet our specifications due to the dozer blade not angling. We have also added some options that bring the total cost of this unit to $58,802.00. The budgeted amount for this piece of equipment is $55,000.00. It is my recommendation that we accept the bid by Central Equipment and include the options on the attached requisition form. Due to cost savings on other pieces of equipment, the $3,802.00 over budget on this item will not put the overall equipment budget over.
