PERMANENT UTILITIES EASEMENT FOR CITY OF ASHLAND
1. Grant of easement. The above named Grantor grants to the City of Ashland, Oregon,
"Grantee," a perpetual non-exclusive easement in gross to construct, reconstruct, install, use,
operate, inspect, repair, maintain and remove and replace public utility facilities including but not
limited to, lines for electricity, sewer, water, gas and telecommunications on real property
described below and further referred to in this easement agreement as the "easement area."
The easement area is located in Jackson County, Oregon, and is described as follows:
See the attached Exhibits A & B.
2. Use of surface. Grantors shall have the right to use the easement area for all purposes not
inconsistent with the uses and purposes of the property, provided that Grantors shall not build or
place any structure upon the easement area without the prior written consent of Grantee.
3. Access to Easement Area. Grantee, its agents, independent contractors and invitees shall
have the right of ingress and egress to the easement area for the purposes connected with this
easement.
4. Notice. Grantee, its agents, independent contractors and invitees shall, upon every occasion
that such public utility facilities are constructed, maintained, replaced, reconstructed, or
removed, provide Grantors reasonable notice and restore the premises of the Grantors, and any
buildings or improvements disturbed by Grantee, as near as practicable.
5. Termination. All rights hereunder shall cease if and when the easement area ceases to be
used for public utility purposes.
6. Prior Encumbrances. This easement is granted subject to all prior easements or
encumbrances of record.

lO-FOOT WIDE PUBLIC UTILITY EASEMENT
ASSESSORS MAP NO. 391E09BB, Tax Lot 2300
A 10-foot wide Public Utility Easement to the City of Ashland, over and across Lots 2,5
and 6 in Block 25 of the 1888 Official Plat of the City of Ashland, Jackson County,
recorded in Volume 1, Page 81 of the Plat Records of said County, as well as that portion
of the Alley vacated by Ordinance No. 2197 as described within Instrument No. 82-
07723 of the Official Records of said County, lying situate within the Northwest Quarter
of Section 9, Township 39 South, Range 1 East of the Willamette Meridian, in said
County, Oregon, more particularly described and bounded as follows, to wit;
Commencing at a one inch square iron bar at the centerline intersection of Laurel Street
with High Street in the City of Ashland, Jackson County, Oregon; thence South
60018'30" East, 34.51 feet to the most westerly comer of Lot 6, Block 25 of the 1888
Official Plat of the City of Ashland; thence North 59018'22" East, along the southeasterly
line of Laurel Street, a distance of 152.80 feet to the POINT OF BEGINNING of a ten-
foot (10.00) wide strip ofland, being five feet (5.00) each side of and parallel with the
following described centerline; thence South 30018'16" East, leaving said southwesterly
line of Laurel Street, a distance of 156.85 feet; thence North 79043'40" East, 109.10 feet
to the POINT OF TERMINUS.
