This agre~ment made and entered into thiathe 15th day
of November, 1907 I betwe,en the 01 ty of Ashland, Oregon, the
arty of the first part and Ella D. Rice,. the part,,. of the 8eo--
ond part, witnesseth:
That for and in consideration of the eum, of one dollar
aid by the party of the first part, the reoeipt of which 1.
hereby acknowlodged, the party of the seoond part h.1'8br grants,
leasee and conveys to the party of the first partl a right of
ay for a four-1noh sewer lateral across the premises.of the
arty of the seoond part to wit: Lot 1, Bloak ~", R. R. Add.
City of Ashland, Oregon, in order to pe~it oonneotion'with the
sewer main on seoond street in said City for any building. now
standing., or which may hereafter be er8oted, on the following
traot of land, to wit: The East 29 feet or. lot 13 in Blook "0.
of the Railroad Addition and a strip of land 55 feet front on
Main street and. 122 feet deep, lying immediately west and. a~-
~oin1ng Block .U", Rail~oad Ad.dition, bs1ng the south, 122 teet
of land described in Deeds recorded in volume 48, page, 47, Deed
Reoord. and also a traot of land fronting ~ feet on Ya.1n Streit
and 122 feet detpbeing the south 122 feet of land desoribed at
page 116, Volume 30, Deed Reoo~d8, JaokeonOounty, Oregon.
The said right of way is granted the party of the first
p':lrt solely and parti'cula,rly for the purpose of affording the
owner or owne'rs of the tracts of land above described, c'onvenient
oonneotion for any buildings on said traots with the s6wer at
a~ atitable point on the sewer main in Seoond Street afore~
named as the same appears on the map of Sewer Distriot No. 6
on file in the office of the City Reoorder of Ashland, Oregon.
The party of the first part agrees to secure that due
care shall be oose1'Ved,by any person or pereone) wila may be en
t1 tled to use such right of way, that in digging and laytJ,ng suoh
sewer conneotion as little damage as possible shall be done to
the premises of the party of the seoond part,and that like o~~
