WHEREAS, Charter's Franchise with the City is due to expire June 1,2008; and WHEREAS, Charter and the City have n<?t yet begun informal renewal negotiations in accordance with Section 626(h) of Title VI of the Communications Act of 1934, as amended and the parties continue to reserve all rights under the formal procedures of Section 626 of Title VI of the Communications Act of 1934, as amended, and do not waive any rights related thereto; and; WHEREAS, Charter has requested that the City further extend the existing franchise while a new franchise continues to be negotiated and the amount of time required to conclude negotiations and allow for public review will extend beyond the extension; and WHEREAS, it is in the public interest to further extend the current Franchise for an additional period of time so that cable service to the public will not be interrupted. NOW, THEREFORE, the Franchise of Charter shall be extended through June 30, 2009 or until a new Franchise Agreement is negotiated whichever comes first.
