A N ACT.
To amend an act entitled "An Act to amend an Act
entitled ~An Act to incorporate the City of Ashland, in
Jackson C unty, Oregon and define the power thereof'," filed
in the ofTice of the Secretary of State, October 14th, 1898.
The people of the City of Ashland, Oregon, do enact as
follows:
Section I. That the act entitled "An Act to amend an
act entitled 'An Act to incorporate the City of Ashland, in
Jackson County, Oregon and define the power thereof'," filed
in the office of the Secretary of State, October l4tih, 1898, be
and tre same is hereby amended by adding thereto ARTICLJ~ XIX,
which shall read as follows:
,A.RTICL~B; XIX.
Section I. All of the lands owned by the City of Ashland,
( except its streets, alleys, and plaza, and excepting also such
lands as are now o\med by it and used for the purpose of taking
rock for street purposes, city pound, hitching ground, pest
house and septic tank,) and particularly that tract known as
the"J'lourting Mill Property", lyinc; between th3 plaza and
Chautauqua Park in said citYt and all lands oWned by saie City
bordering upon, or adjacent to Ashland Creek and extending into
the Ashland Forest reserve, are hereby reserved and forever
dedicated to the people of the said city for Park purposes and
shall never be sold, leased, incumbered, or used for any purpose
inconsistent therewith; provided, however, that such public
bUildinGs as may enhance the beauty of said park, or that shall
'not detract therefrom, may be constructed, if so directed
by a majority vote of the. electors of saie.city, B.nd provided
further, thatnothipg contained in this act shall be construed
so as to impair or interfere 'Vii th the proper construction or
operatir:n of the City's IJiG~lt, Power or Water system.
The south boundary of the plaza above referred to shall
be the south boundary line of Mill Street, from the northwest
corner of the said Flouring Mill Property, projected easterly
to an intersection with the Chautauqua Park Grounds. Nothing
contained in this act shall be construed to prevent tte Ci ty
Council from makinc street connection between Mill Street and
Granite Street at any point they may select.

Section II. A board shall be created which shall be known
anr1 designated as the "Ashland Park Connnission" and shall
consist of' five citizens, residents of the said city, two of
whom may be 'Nomen and each ward of the ci ty shall be represented
thereon.
The said commission shall b e elected to serve for a term
of five years or until their successors are elected and qualifi-
ed. The first commission shall be appoin~ed by the Mayor and
by and with the approval of the council at its first regualr
meeting in the month of' January A. D. 1909. The commission so
appointed shall meet within one week after appointment and
organize by the election of one of their number as President and
one as Secretary, and shall at that time denrrnine the term of
office of each member, so that the tern of lU: one shall expire
in One year,one in two years, one in three years, one in four
years and one in five years, and thereafter at each subsequent
annual city election one member shall be elected to serve for
the tern of five years.

Section III. The said Park Con~ission shall have control and
management of all the lands here dedicated for Park purposes
and of all 0 ther lands that may hereafter be rtcquired by the
City for such purposes. Tre y shall have control and management
of all Park funds, whether the same is obtained by taxation,
donation ~r ~~Pr~~~~)R~d shall expend the same judiciously
for beautlfYlng,,'Lne Cl't1ts Parks. '
It shall be the duty of said Conunission and they shall
at the beginning of each month, file with the City Recorder for
the information of tiE City Council and the pUblic a report
of their doings for the preceding month. Such report shall
specify all funds on hand and the source from whence obtained.
It shall carry a clear statement of all moneys expended and for
what purpose. All purchases made and all lr:'bot performed
together with the cost thereof shall be embodied in said report.
At thetime for making the tax levy for general city
purposes in each year, the said commission shall cause a care-
ful estimate to be made of the money required for Park purposes
for the ensuing year, and file the same with the City Recorder
whereupon there shall ce included in said general levy no~ to
exceed two (2) mills on the dollar to meet'such requirement,

and shaLL have power to formulate a.n adopt rules and regula-
tions for their government and for the purposes of carrying
into effect the purposes of their creation as a Park Cormnission.
Tle y shall enter upon the discharge of their duties i1TIT1ediately
upon their organization and shall, as soon as may be expedient
cause a map, or maps to be made of the lands herei~dedicated,
and shall make the same confo nn to the descriptions contained in
the instruments by which said ci ty obtained ti tl e thereto;
which said instrwnents shall be considered as carrying a more
specific description of said lands.
