FIRST EXTENSION TO CONTRACT FOR CABLE TELEVISION SERVICES
BETWEEN THE CITY OF ASHLAND AND ASHLAND HOME NET CORP.
WHEREAS, on September 22, 2006, the City of Ashland, acting by and through
Ashland Fiber NetworkCable Division, entered into a Cable Television Services
Contract with Ashland Home Net Corp to provide cable television services (hereinafter
"Contract"); and
WHEREAS, the Contract term began on September 22, 2006, and expires on
September 22, 2009; and
WHEREAS, AHN and AFN have engaged in negotiations and the City of Ashland is
currently preparing a Request For Proposals ("RFP") to solicit proposals to hold an agreement
and cable franchise with the City; and
WHEREAS, the parties continue to reserve all rights under the formal procedures of
Section 626 of Title VI of the Communications Act of 1934, as amended, and do not waive any
rights related thereto; and;
WHEREAS, AFN, by and through its Director, Michael Ainsworth, has determined it is
in AFN's best interest to extend the Contract for one additional year in accordance section 4 of
the Contract so that an RFP can be issued and proposals solicited for a new agreement and
franchise with the City; and
WHEREAS, an extension is also warranted so that there will be no service interruption
during the RFP process; and
NOW THEREFORE, the Contract is herby amended as follows:
1. The recitals set forth above are true and correct and incorporated herein by
this reference.
2. The Contract is hereby amended to reflect a one (1) year extension from
September 22, 2009 to September 22, 2010; and
3. All other provisions of the Contract not inconsistent with the above extension
remain in full force and effect.
