A RESOLUTION ADOPTING A FEE SCHEDULE PURSUANT TO THE
CITY OF ASHLAND MUNICIPAL CODE, CHAPTER 18.61.
Recitals:
A. Ashland Municipal CDde Chapter 18.61.020.N [Tree AccDunt] authDrizes the CDuncil
to establish an account for the receipt Df funds to be utilized fDr future tree purpDses.
B. Ashland Municipal Code Chapter 18.61.084.C [Payment in lieu of planting]
authorizes the Council to set a fee tD be paid into the tree account if "nD feasible
alternative exists tD plant the required mitigatiDn."
C. Ashland Municipal Code Chapter 18.61.130.B [Enforcement Fee] authorizes the
Council tD set a fee to be paid to the City as restitutiDn tD recover the CDStS Df
enforcement.
D. Ashland Municipal Code Chapter 18.61.130.C.1 [RestDratiDn Fee] authorizes the
Council to set a fee to be paid tD the tree aCCDunt as restitutiDn tD the city to recover the
costs Df restDring trees.
THE CITY OF ASHLAND RESOLVES AS FOllOWS:
SECTION 1. This resolution hereby establishes a Tree Account for the receipt of funds
to be utilized fDr future tree purpDses.
SECTION 2. Payment in Lieu of Planting Fee. The payment shall be Df an amDunt
equivalent to the estimated cost Df buying and planting the trees that would otherwise
have been required to be planted on site, or a minimum of $400.00. Payment in lieu of
planting trees on site shall be to the City of Ashland Tree fund and made at the time of
the signature Df the final survey plat, prior to the issuance Df any building permit for the
property Dr prior tD the issuance of a Certificate Df Occupancy or priDr to the cDmpletion
of the project permit requiring the tree replacement, whichever Dccurs first.
SECTION 3. Enforcement Fee. In addition tD the General Penalty fees stated in
Ashland Municipal Code Chapter 1.08.010, an enforcement fee of $75 per hour with a
minimum of $150 shall be assessed to reCDver City expenses relating tD enforcement Df
any violation of Chapter 18.61. The enforcement fee shall increase annually in July of
each year, by multiplying the fee by a fraction, the numerator of which is the CPI Index
Figure fDr the month of March proceeding the July in which the fee is to be increased
and the denDminatDr of which is the Base CPI Index Figure. As used in this section,
"Index" refers to the All Urban Consumers (CPI-U). U.S. City Average, CPI Index
published by the Bureau of labor Statistics of the United States Department of labor.
"Base CPI Index Figure" shall refer tD the Index number indicated fDr the month Df
March, 2006, and the "CPI Index Figure" for any other mDnth shall refer tD the Index
number for that month.

SECTION 4. RestDration Fee. The fee shall be paid into the City's Tree Account and
shall be a standard fee of $150 per caliper inch for the total number of caliper inches of
the tree damaged Dr remDved in violation Df this chapter.
SECTION 5. This resolution was duly PASSED and ADOPTED this .,.t.- day of
