AN ORDINANCE PROVIDING FOR THE OPERATION AND EQUIPMENT OF BICYCLES
WITHIN THE CITY LIMITS OF THE CITY OF ASHLAND, OREGON; FIXING PENALTIES
FOR VIOLATION THEREOF; REPEALING ORDINANCE NO, 997 RELATING TO THE SAME
SUBJECT; AND DECLARING AN EMERGENCY.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. Definition of words and 'phraseso The following
words and phrases when used in this Ordinance shall, for the purpose
of the Ordinance have the following meanings:
(a) Bicycle. The term "bicycle" means every device
propelled by human power upon which any person may ride
having two (2) tandem wheels either of which is more than
fifteen (15) inches in diameter.
(b) Bicycle Path. A pathway for bicycles and pedes-
trians paralleling a roadway, the side of the bicycle path
closest to the roadway being not more than seventy-five (75)
feet distant from said roadway.
(c) Chief of Police. The term "Chief of Police" as
used herein shall be deemed to mean the Chief of Police
of the City of Ashland or his designee.
(d) Rental Agency. Any person, firm, copartnership,
association, or corporation engaged in the business of
offering for rent and renting bicycles for use by members
of the public.
SECTION 2. Equipment. The following equipment is required
on all bicycles and it shall be unlawful to operate a bicycle without
its having such equipment:
(a) Brakes. Brakes adequate to control the movement
of and stop and hold such bicycle.
(b) Lights. No bicycle shall be permitted on any bicycle
path, street, or any other highway between thirty (30) minutes
after sunset and thirty (30) minutes before sunrise without a
clear white light visible under normal atmospheric conditions
from the front for not less than five hundred (500) feet
indicating the approach or presence of the bicycle, and also
a red light or reflector mirror visible for three hundred (300)
feet from the rear; said lights, or reflectors, must be
attached to the bicycle or in the alternative an arm light
may be used which may be placed on either the arm or the leg
of the bicycle rider.
SECTION 3. Regulations. The following regulations apply to
the operation and use of bicycles;
(a) Riding on Sidewalks. No person shall ride or
operate any bicycle on a sidewalk in a central business
district or commercial zone.
(b) Racing. No person shall engage in or cause others
to be engaged in a bicycle race upon the streets or any other
public property of this City without the permission of the
Chief of Police.

(c) Method of Riding. A person shall not ride a bicycle
other than with his feet on the peddles and facing the front
of the bicycle. No bicycle shall be used to carry more
persons at one time than the number for which it is equipped.
(d) Carrying Articles. No person operating a bicycle
shall carry any packages, and bundles or article which
prevents the rider from keeping at least one hand upon the
handlebars and in full control of said bicycle.
(e) Traffic'Regulations. The use of a bicycle in the
City of Ashland shall be subject to all of the provisions of
laws of the State of Oregon and the laws of the City of
Ashland including those applicable to the drivers of motor
vehicles except as to the latter, those provisions that by
their very nature, have no application; and bicycles when
ridden on a street or highway shall be ridden at the right-
hand side of the street or highway within five (5) feet of
the curb when possible, and shall pass to the right when
meeting vehicles.
(f) Speed on Bicvcle Paths. No bicycle shall be ridden
on a bicycle path at a speed greater than ten (10) miles per
hour..
(g) Riding Abreast. No person shall ride a bicycle
upon any street, highway or bicycle path in the City abreast
of any other person so riding or propelling a bicycle.
(h) Hitching on Vehicles. No person while riding a
bicycle shall in any way attach himself or his bicycle to
any other moving vehicle.
(i) Taking or Using Without Permission. No person
shall take or use any bicycle without the consent of the
owner.
(j) Riding While Intoxicated. It shall be unlawful
for any person to operate a bicycle on any street or highway
or bicycle path of the City while under the influence of
intoxicating liquor.
(k) Parking. No person shall park a bicycle upon a
street other than in the roadway and against the curb, or in
a rack provided for the purpose of supporting bicycles; or
on the curb in a manner so as to afford the least obstruction
to pedestrian traffic. When a parking rack is provided, no
person shall park a bicycle except in such rack and within
a distance of three hundred (300) feet of such rack.
SECTION 4. Right-of-Wav. The operator of a bicycle emerging
from an alley, driveway, bicycle path, building or otherwise approaching
on a sidewalk or a sidewalk area extending along any such area, shall
yield the right of way to all pedestrians approaching on such sidewalk
or sidewalk area, and upon entering the roadway shall yield the right-
of-way to all vehicles or bicycles approaching on such roadway that are
so close as to constitute an immediate hazard.

SECTION 5. Responsibility of Parent or. Guardian. The parent
or guardian of any child shall not authorize or knowingly permit any
child to violate any of the provisions of this Ordinance.
SECTION 6. Accidents. The operator of any bicycle involved
in an accident resulting in injury, death or damage to personal property
shall within seventy-two (72) hours file a written report of such
accident with the Ashland Police Department.
SECTION 7. Penalties. Any person who shall violate any of
the provisions of this Ordinance shall, upon conviction thereof, be
punished by a fine not to exceed Five Hundred Dollars ($500.00), or by
imprisonment, not to exceed sixty (60) days, or by both such fine and
imprisonment.
Upon conviction, the court may, in addition to any other
penalty, order that the bicycle that was used at the time of the offense
be impounded until such time as may appear just and reasonable.
SECTION 8. Ordinance No. 997 entitled "An Ordinance Providing
for the Registration, Licensing, Operation, and Equipment of Bicycles
Within the City Limits of the City of Ashland, Oregon; Fixing Penalty
for Violation Thereof; Repealing All Ordinances or Parts of Ordinances
in Conflict Therewith; and Declaring an Emergency" is hereby repealed.
SECTION 9. That inasmuch as it is deemed necessary for the
public health, peace and safety of the citizens of the City of Ashland,
the provisions shall be made immediately operative, it is hereby declared
that an emergency exists and this Ordinance shall be in full force and
effect from and after its passage by the Council and approval by the
Mayor.
The foregoing Ordinance was first read at a regular meeting
