':. . ~, . \. ~ ORDINANCE NO. /J. 73 An ordinance fixing rates to be charged for water, service by the City of Ashland, oregon; providing for the inspection and ad- justment of. faulty';,ater meters; fixing rules and regulations for the conduct and operation of the water system of said city; pro- viding for ,penalties for non-payment of water services and for the /violation.of. rU.les an. d regulations thereof;vrepealing ordinances #1113 and #113~ and all ordinances and parts of ordinances in con- flict herewith 'and declaring an emergency. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOvJS: Section 1. METER RATES FOR RESIDENCES The monthly rates, unless otherwise specified, to be charged to consumers of water for residential uses which shall-include residences, separate metered' duplexes, individual apartments, and the lawns, trees, shrubbery, and any area under cultivation less than one half acre in size adjacent thereto for the use of water ,supplied I fro~ and .Co _.__~ - .. . from the cIty water s'y'stem of the',Ci ty, of ASP. 1 and', oregon, after the first day of July, 1960, shal~ be as follows: Minimum Monthly Charge~ $2.50 for 1000' ft. of ,vater l' '. cu or ess' Next 9000 cu ft of water at 8<:: per 100 cu ft Next 10000 ,cu ft of water at 6<:: per 100 cu ft Excess at 5<:: per 100 cu ft In the event more than one residence is on a meter, the mini- '.l. mum charge shall be made for each residence and the quantity of cubic feet in each block of the 'above schedule shall be multiplied ----- by the number of residences ,on each meter. The Water Superintendent shall have the authority to require that each residence be separ- ately metered. Section 2. METER RATES FOR BUSINESSES The following rates are hereby fixed and specified as the minimum rates to be charged' per month to consumers of water. Thi s ,,' -. . J -2- " rate schedule applies to all accounts within the city limits of Ashland except single family residences, separately metered dup- lexes and individual apartments, and where more than one residence is served by a single meter as set forth in Schedule I. SECTION 3. METER RATES FOR BUSINESSES AND RESIDENCES OUTSIDE CITY LIMITS The following rates are hereby fixed and specified as the , , minimum rates to be charged all consumers outside of the city limits of the, ctty of Ashland of water for both residence and businesses. Minimum Charge: $2.50 for 750 cu ft , ' Excess 10<:: per 100 cu ft , , .... , .. -3- SECTION 4. IRRIGATION RATES 1. Any person or persons desiring water through city water mains (\Vhen same cannot' be 'supplied by T I D'lines) for irrigation purposes for any premises in excess of one-half acreA shall pay therefor 2~~ per 100 cu ft for all water used during the period ,.'1-)~~L from May 15 to October 15 of each and every year and shall have a separate meter therefor:. ___7 2. Water ~sed for irrigationpu~poses during the irrigation season shall not be allo\Ved to be wasted or run off the property where it is supposed to be used and water from city \Vater mains shall not be,used between the hours of 10:00 P. M. and 5:00 A. M. of each day and in case of shortage of \Vater, other rules made by the Water Superintendent and the Water Committee shall be, observed the same a$ this ordinance. / 3. Th-6se consumers u'sing Talent Irrigation water shall be ,-I~"'::- cparged the rate of $12.50 per acre, or portion of acre, per year.7- 4. All persons using Talent Irrigation \Vater having grievances as to amount of land checked by the city \ll\ay, upon application to the City Recorder, have the same rechecked at any time and if upon 'the rechecking an overcharge is found to have been made by the ci ty, there shall be no charge made for said rechecking; otherwise, the party aggrieved shall pay the cost of such rechecking at the rate of $2.00 per hour for each man required in so doing. At any' time:,: when due to shortage of water supply the <- ~ Water Superintendent, in hi~ discretion,d~ems it necessary for the public health and safety of the citizens of Ashland ~..~r may order all water for ,irrigation purposes discontinued 'or establish hours that the services may be'used, even though no discontinuance or curtail- ment of residential and business consumption~+s required. ,..A' SECTION 5. PATI1ENT OF BILLS Bills are due and payable at the recorder's office or to an authorized collector, on the date of mailing or presentation, and become delinquent ten (10) days thereafter, except irrigation charges as set out in Section 4. SECTION 6. ,DEPOSITS AND RETURN OF DEPOSITS A deposit is an amount deemed sufficient by the Water Com- mittee of the City Council shali be required of any person, firm, or corporation desiring water, as security for the water service to be furnished said ,person, firm, or corporation. In every case the property Qvmer,or his duly appointed agent shall pay all charges for water services, and in case the charges are not paid, same shall become a lien on the particular property affected and benefited, which shall be collected in the same manner as all other city liens. A deposit need not be made if the applicant for a reasonable time infue past has promptly paid all accounts due the city and , . .' J . ~'_ -5- otherwise convinces the city superintendent that bills will be paid when due. SECTION 7. COMPUTING CHARGES AND DISPUTING ERRONEOUS CHARGES In computing meter charges, results ending in one and two cents will be counted zero; results ending in three, four, five, six, and seven cents \Vi~l be counted five; results ending in eight and nine cents will be counted ten cents. Whenever any metered customer shall make complaint that the bill for any month is excessive, the water superintendent shall, upon request, have such meter reread and service inspected for leaks. In case nothing is found faulty from said cursory inspec- tion and the customer shouid ,then d~si~e th'at', the' ~eter be 'tested, . ":. ~.'., ) the city may 'require the customer to deposit an amount to cover the reasonable cost of the test. Th~ amount of depostt shall be at . , the rate of $2.50 ,per inch diameter of, meter but not less than , '$2.'50. The deposit will be returned to the customer if the meter is found upon test to over-register more than ~/o under conditions of normal operation. In case of a non-registering meter the city may bill the cus- tomer for water consumed while the meter was not registering. The bill will be at the minimum monthly rate or will be computed upon an estimate of consumption bas'ed either upon the customers' prior use during the same season of the year or upon a reasonable com- parison with the use of other customers receiving the same class of service during the same period under a similar circumstance and condition. . -6~, .', " SECTION 8. All property having connections with the city water mains or laterals shall be held liable for all charges for water used in the building or on the premises of, such property, whether one or more houses, families, or persons are on the same service or otherwise. Provided, however, that' in case of carelessness of the ,property owner in the handling of the stopcock, ,which shall render it necessary to renew said stopcock, then the property o,vner shall pay for the new st~pcock and labor of installing same. 2. All taps being made. in alleys or where there are no streets or alleys, or any other places not provided for in this ordinance, shall have the cost of such determined by the Super in- tendent of water works and the Water Committee and the charges .made aCCOroing to their findings. 3. Any applicant for water, or occupant of premises supplied, desiring an additional service or supply or fixture, or to apply . . SECTION 10. \ TEMPORARY'~ISCONNECTION OF SERVICE Any ~~rson wishing to discontinue the use of water supplies .' to the premises for a period of not less than one month without paying for the same must give notice in writing thereof to the City Recorder and pay to him all arrearage, if there be.' any, whereupon he shall cause the superintendent to turn the water off, and to turn it on again for applicant without further charge. SECTION 11. LIABILITY OF CITY WHEN NO WATER The water may at any time be turned off or shut off from the mains without not~cefor repairs, extension, or other necessary- purposes, and the City will in no case be responsible or liable to damage to any water consumer. SECTION 12. FIRE .ALARMS It shall be the duty of each and every person whose house, place of business or premises is furnished \Vith city water for any purpose whatever to turn off the same immediately on the sounding of the fire alarm. Any failure to comply\Vith this section shall be deemed a violation hereof and punished as hereinafter provided. 1?ECTION, 13., 1. It shall be unlawful for any person or persons to make connections 'with ,the c;:ity mains,_ 9r laterals, or to make altera- . tions in any conduit, pipe or other fixture connected there\Vith, or to connect pipes when they have 'been disconnected or to turn ~ater off on any premises without \Vritten permission from the Water Com- mittee or Water Superintendent. ~, ~'~ '. ,~ , " ".' It shall be unlawful for any person or persons during the period that said water remains turned off to use water t~cen from any faucet, hydrant, t~p or connection situated on premises from whic~ the water has been turned off by any duly authorized employee or agent of the.City of Ashland. . .~" 3. It shall be unlawful for any person or persQ:ns to turn off the water or to turn on the same, or in any way or manner to interfere or' tamper with any corporation stopcock, blowoff, or , fire hydrant or other discharge o....ned and controlled by the City, exc~pt in case of.an accident to or by reason of which event it may be turned off. Provided furfu er, that on proper 'application and showing in writing to the Water Committee for ~uchprivileges, a written permit granted by said committee'shall relieve such per-. 'son or persons from the charge of a violation of this section. SECTION 14. FAILURE TO COMPLY WITH RULES On failure of any consumer to comply with the rules and regulations hereby established, as a condition to the use of city water, or to pay, the, rates hereby established on or before ten days' after ,the same becomes due, the \Vater supply to any such consumer may be shut()ff without notice'by the Water Superinten- dent until such time as payment is made of the amount due, to- gether with the sum of fifty cents additional for the expense of turning the same off and on. SECTION 15; Each and every violation of any of the provisons of the foregoing ordinance shall be, and is hereby declared to be an un- lawful act, and ~pon complaint made in writing therefore, sub- scribed and sworn to and filed ~ith the c~tY:Reco~der of the Ci ty of Ashland, shall be sentenced 'to J?ay a, fine of not less than' " " -9- :;;:.9., ,.,. Five Dollars nor more than Twenty Dollars, and in case of default of said payment of such fine shall be imprisoned in the city jail for a period of not to exceed ten days at the discretion of the City Judge.. SECTION 16. That ordinances 'No. #1~i:3' and #~i39 and' all other ordinances , J, . and parts of ,ordinances in ,co,nflict herewith are hereby repealed. : , , SECTION 17. That inasmuch as it is necessary to have the change in water rates herein made effective the 1st day of July, 1960, it is hereby deemed necessary for,the pub~ic peace, health and safety of the citizens of the City of Ashland that an emergency be, and the same is hereby declared to exist, and this ordinance shall be in full force and effect from and after its passage by the Council and approval by the Mayor.
