HomeMy WebLinkAbout1981-081 Annexation Req - YMCA PA 81-59PLANNING ACTION #81-59 is a request for Annexation and Zone Change for 3.98 acres o property ocate at 2245 Ashland Street. The property is designated as Rural Residential 5 in the County, and the applicant is requesting that it be rezoned to C-1 (Retail Commercial) upon annexation to the City. A portion of the property is already in the City limits and is the site of the present YMCA facility. Comprehensive Plan Designation: Commercial Retail. Zoning: Rr�-;5. Assessor's map 11C. Tax lots: 800, part of 1000. APPLICANT: Ashland YMCA. In reviewing the data and testimony which are in the records of Planning Action #81-59, we make the following conclusory findings: 1) That subject property is located within the City's Urban Growth Boundary. 2) That, with the exception of water, there exists adequate public facilities to service subject property. 3) That the applicant has submitted evidence which indicates that the YMCA's well will be able to satisfy the water demand of subject property. 4) That there exists a need for vacant C-1 land within the City limits. 5) That the request, with attached conditions, minimizes the impact on the neighborhood and the City as a whole. 6) That C-1 is the appropriate zoning designation to apply to the property when it is annexed to the City. This is based upon the Retail Commercial designa- tion of the property in the City's Comprehensive Plan. 7) That the land is contiguous to the Ashland City limits. 8) That the City's Urban Growth Boundary has been agreed to by Jackson County. Based on our overall conclusions and upon the proposal being subject to the following conditions, we approve Planning Action #81-59. Further, if the follow- ing conditions are found to be invalid, for any reason'whatsoever, then Planning Action #81-59 is denied. The following are the conditions and they are attached to the approval: 1) That the proposed property sign in favor of the Tolman Creek Traffic Signal Assessment District. 2) That the applicant sign in favor of future street improvements on Tolman Creek Road, including sidewalks. 3) That a drainage way easement be provided as according to the condition applied to the Minor Land Partition. 4) That sewer, water, sturr� urair�age frum ine property be approved by tngineering prior to any development. 5) That no further partitioning of the land be permitted prior to the filing of a master plan for development of the entire site, showing common ingress and egress, parking areas, landscaping and generalized areas for building, and detailed engineering plans of the water system and any storage systems. 6) That future hook-up to the City's water system be provided for and upon solution to the water problem existing in the area that the applicants agree to hook up to the City's water system. 7) That a deed restriction is entered into and recorded which will be binding upon the owners, their heirs, successors and assigns and to run with the lard and to be in substantially the following words: "Water for use on the subject land will be supplied by the rlshland YMCA. The City of Ashland will not be morally or legally obligated nor requested to furnish water until the City, in its judgment, finds that its water system has been imaroved so as to make furnishing of water consistent with good water management practices. At that time all of the subject land that is developed shall be connected to the City of Ashland's water system and this provision shall no longer be in effect." ���-�r� L.
