Bar2ain and Sale Deed
The STATE OF OREGON, Acting By and Through the STATE BOARD OF HIGHER EDU-
CATION for and on Behalf of OREGON INSTITUTE OF TECHNOLOGY, Grantor, conveys to
the CITY OF ASHLAND, Grantee, the following described real property:
Beginning at a stone monument marking the Southeast corner of Tract 47 of
ASALAND ACRES in Jackson County, Oregon, said monument being on the East
line of Donation Land Claim No. 45 in Section 10, Township 39 South, Range
1 East, Willamette Meridian, Sackson County, Oregon, at a point 792 feet
South of the Northeast corner of said claim; thence East 20 feet to the
Northwest corner of tract described in instrument recorded as Document No.
67-07719, Official Records of Jackson County, Oregon; thence South, along
the West line of said tract, and the West line of tract described in in-
strument recorded in Volume 572, Page 286, Jackson County, Oregon, Deed
Records, 970.24 feet more or less to the Southwest corner thereof; thence
West 20 feet to the East line of said Donation Land Claim No. 45; thence
North along said East line 970.24 feet more or less to the point of begin-
ning.
The above described real property was owned by Jackson County, Oregon,
resident, William W. Erb, who died in 1907. Although the above-described real
property was not described in any of the documents in the probate of the estate
of the said William W. Erb, title to said real property passed to Laura Erb and
Ada Erb, the widow and daughter, respectively, of the said William W. Erb.
Laura Erb died circa 1941, without having disposed of her interest in said real
property and, at her death, her interest therein passed to the daughter, the
said Ada Erb. The said Ada Erb was married and her name became Ada Matthews.
The said Ada Matthews died testate in March 21, 1967, leaving surviving her no
spouse nor issue. The Will of Ada Matthews left the residue of her estate,
including the above-described real property, to the State of Oregon, acting by
and through the State Board of Higher Education, in trust, for the establishment
of a loan fund for the assistance of residents of Klamath County, Oregon, in
obtaining education at Oregon Technical Institute (now Oregon Institute of
Technology) in Klamath County.
The true and actual consideration for this transfer is TWO THOUSAND AND
NO/100 DOLLARS ($2,000.00).
IN WITNESS WHEREOF, Grantor caused this deed to be executed and seal
affixed this Z�� day of �v�� 1981.
