corporation in the State of Oregon, the receipt of which is hereby
acknowledged, do GRANT, S�LL, CONVEY AND MORTGAGE unto said CITY OF
ASHLAND, all of the following described real property situated in
the City of Ashland, County of Jackson, State of Oregon, to-wit:
Lot 12, Block 9, Terra Linda Subdivision No. 2,
City of Ashland, Jackson County, Oregon.
TO HAVE AND TO HOLD all and singular the said premises to-
gether with the tenements, hereditaments and appurtenances, unto the
said CITY OF ASHLAND, a Municipal corporation in the State of Oregon,
forever.
This conveyance is intended as a Mortgage and is given to
secure the payment, according to its terms, a Promissory Note in the
sum of $770.00

Bernhard Binder and Helga Binder, husband and wife,
promise to pay to the order of the CITY Or ASHLAND, a P4unicipal cor-
poration of the State of Oregon, at Ashland, Oregon, the sum of
Seven Hundred Seventy Dollars and n
with interest thereon at the rate of ten percent
10� per annum from date hereof, until paid, payable as follows:
Seni-annual installments of not less than the in-
terest accrued to date plus Thirty-eight dollars
and fifty cents ($38.50)
until the entire sum of Seven Hun re even y

plus interest is paid in full. The first such
installment shall be due on October 1, 1981.
the second installment on April 1, 1982
with semi-annual installments to be due and pay-
able on the first day of April and the
first day of October thereafter until the
entire sum of principal and interest is paid in
full. If any of said installments is not paid,
then following thirty (30) days written notice of
such default given to the makers of this note,
the whole sum of both principal and interest is
to become due and collectible at the option of
the holder of this Note. If this Note is placed
in hands of an attorney for collection, we prom-
ise and agree to pay holder's reasonable attor-
ney's fees and collection costs even though no
suit or action is filed hereon, however, if a
suit or action is filed the amount of said attor-
ney's fees shall be fixed by the court or courts
in which the suit or action, including any appeal
therein, is tried, heard or decided.

Mortgagors hereby covenant and agree to pay all taxes, assess-
ments and public charges that may be levied against the above describeu
real property on or before'the due date thereof, and shall not suffer
or permit any of said assessments or charges to become delinquent.
In the event the within Note is paid strictly in accordance'
with its terms, then this conveyance shall be void, otherwise-it shall
remain in full force and effect.
It is further agreed that in case of suit or action to en-
force any riqht to foreclose this agreement and upon any appeal of a
higher court, it is mutually agreed that the prevailing party in such
suit or action shall be entitled to a reasonable attorney's fee as
determined by the Court, as against the losing party therein.
