, KNO" ALL MEN BY THESE PRESENTS, that David ,E. Greene and Charlotte A, Greene,
husband and wife, Grantors in consideration of twenty-five and 00/100 ($25.00) Dollars
to them paid by the CITY OF ASHLAND, a municipal corporation of the State of Oregon,
Grantee, do hereby grant, bargain, sell and convey unto the said Grantee, its
successors and assigns, the water rights on 0.146 of an acre in the Northwest one-quarter
of the Southwest one-quarter of Section 4, Township 39 South, Range 1 East of tlle
Willamette Meridian being further described as follows:
Commencing at a found 1 inch galvanized iron pipe situated at the Accepted
Northwest corner of Donation Land Claim No. 40, said Township and Range;
thence South 34005138" East (deed record South 34006' East, 818,65 feet)
818,65 feet; thence South 89056' 38" East (deed record South 89057' East,
489,50 feet) 489,75 feet to a point in the Westerly right of way of Willow
Street; ,thence South 13020'56" West (deed record South 13015' West) along
said-right of way, 143.83 feet to a 5/8 inch iron pin for the True Point
of Beginning; thence leaving said right of way North 71" 55' 37" West, 102.40
feet to a 5/8 inch iron pin; thence North 13020'56" East, 53,975 feet to a
5/8 inch iron pin; thence South 81002'40" East, 102,35 feet to a '>/8 inch
iron pin situated in the Westerly right of way of Willow Street; thence
South 13020'56" West along said right of way, 70,25 feet to the point of
beginning. Containing 0.146 acre, more or less,
all within and part of that certain water right situated in the County of Jackson and
State of Oregon, described as follows to-wit:
G,W, Hake, Ashland, Ore., (Proof 167, Vol. 4); Priority 1858; 0.05 second
foot; for Irrigation of 2 acres; Helman ditch; Description of place of use;
2 acres in ~1N~SW~; Sec. 4, and NE~S~; Sec. 6; Tp. 39 S. R. 1 E.W.M.,
beginning on E, line of 0, & C,.R,R. right of way, whence NW corner of
D,L,C, No, 40, Tp. 39 S. R, 1 E,W,M. bears N, 34 deg, 6 min. W. 818,65 ft;
thence S, 89 deg, 57 min. E.' 489.50 ft; S, 13 deg, 15 min, W. 279.5 ft;
N, 63 deg. 45 min. W, 205.65 ft; S, 60 deg, 57 min, W. 92.2 ft, to said
right of way; N. 34 deg, 45 min, W, 177,5 ft; N. 36 deg, 19 min, W. 100 it,
to beg" containing 1,95 acres; Jackson County, Oregon.
To have and to hold the above described water right unto the said Grantee, its successors
and assigns forever.
And the Grantors covenant that they are lawfully seized in fee simple of the
above granted water right free from all encumbrances, and that they will, and their
heirs, executors and administrators shall, warrant and forever defend the above
granted water right against the lawful claims and demands of all persons whomsoever.
