Further providing that said proposed charter amendments to be submitted to the electors of the City of Ashland under a ballot title herein set forth for their approval or rejection at a special election hereby called and to be held on the 3rd day of November, 1970, and declaring an emergency. WHEREAS, there is a special election called for by the Common Council of the City of Ashland in March of 1970 to amend the charter of the City of Ashland, and WHEREAS, the voters passed the proposed amendment to the. charter, and WHEREAS, the amendments of 1970 provided; that, the water works and park property should never be rented, sold, or otherwise disposed of; and it appears that the charter should make the same provisions as to the sewer and electric power utilities. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Common Council of the City of Ashland: Sect i on 1. That amendments to the Charter of the City of Ashland, Jackson County, Oregon, be and the same hereby is, proposed and referred for submission ,to the legal voters of said City at a special election hereby called and to be held on the 3rd day of November, 1970, which Charter amendment, to be so referred, is as follows: CHARTER AMENDMENT REFERRED TO THE VOTERS BY THE MAYOR AND COMMON COUNCIL AN ACT To amend and revise the 1889 Charter as amended of the City of Ashland, Jackson County, Oregon. That Article XVI, Sections 1 and 5, of the 1889 Charter of the City of Ashland, as amended, be, and the same hereby is am- ended to read as follows: ART! CLE XVI - Mi sce 11 aneous P rovi s ions Section 1. Public Utilities - Water Works. The city of Ashland, a municipal corporation, shall have the power to provide the residents of said city with such services as water, sewer, electric power, public transportation and such other public utilities as the people desire by majority vote; and to exact and collect compensation from the users of such public utility; provided, however, that the electric power, water and sewer system and the property appurtenant to their use now owned or which may hereafter be acquired by said city for the purpose of supplying the inhabitants thereof with such electric power, water and sewer shall never be rented, sold or otherwise disposed of; nor shall the city ever grant any franchise to any person or corporation for the purpose of supplying the inhabitants of said city with such electric power, water and sewer; provided further, however, that the electors of the city of Ashland may form a people's utility district to supply such electric power, water and sewer under the provisions of Oregon Revised Statutes, Chapter 261. And provided further that the Mayor and Common Council must call a special election to amend this charter provision before making any other disposition by forming a people's utility district. Section 5. Time of Effect of Charter Amendment. This amendment to the charter of 1889 shall take effect January 1,1971. Sect i on 2. That the Recorder, W. E. Bartelt, shall appoint and certify an election board which shall act as a counting board in each precinct. That the election board certified by the county clerk shall serve as the election board during the time the polls are open. That the respective polling places lawfully designated for the said general election held on the same day at the same time are hereby designated as the polling places for the special general election. Polls will be open from 8 a.m. to 8 p.m. Pacific Standard Time on November 3, 1970 for said special election. Sect i on 3. Purpose: To amend Article XVI, Sections 1 and 5, of the 1889 Charter of the City of Ashland, as amended, by providing that the electrical power, water and sewer system shall never be rented, sold, or, otherwise disposed of, without a vote of the people; and setting January 1, 197t as' the effective date of the.amendments. . That the City Recorder is hereby requested and directed to give due notice of such special election herein called as pro- vided in the Charter and Ordinances of the City of Ashland, Oregon; that is to say, notice of the calling of said election, the time and places for voting and.the ballot title shall be published in the Daily Tidings, a newspaper of general circulation printed and published in said city, at least once ten days prior to the date fixed herein for holding said election. Section 5. That inasmuch as it is necessary that the proposed Charter amendment be voted on at the general election in order to save expense to the City, it is hereby deemed necessary for the peace, health, safety and general welfare of the citizens of the City of Ashland that an emergency be, and the same is hereby de- clared to exist, and this resolution shall be in full force and effect from and after its adoption by the Council and approval by the Mayor.
