RESOLUTION 7C> ".J'" A resolution proposing an amendment to the 1889 Charter of the City of Ashland, Jackson County Oregon, as amended by the various charter amendments to date. Further providing that said proposed charter amendment be submitted to the electors of the City of Ashland under a ballot title herein set forth for their approval or rejection at a special election hereby called and to be held on the 3rd day of November, 1970, and declaring an emergency. WHEREAS, there is a special election called for by the Common Council of the City of Ashland in March of 1970 to amend the charter of the City of Ashland, and WHEREAS, the voters passed the proposed amendment to the charter, and WHEREAS, the amendments of the May 26, 1970 charter removed the requirement that the appointive officers be residents, and WHEREAS, it appears that appointments to commissions and appointed officials should be residents, and WHEREAS, the amendments of 1970 also take away from the counci.l the right to remove any appointed officer, and WHEREAS, it appears that power should be restored to the council so that an appointed office may have some recourse in the event of suspension by the Mayor. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Common Council of the City of Ashland: Sect ion 1. That amendments to the Charter of the City of Ashland, Jackson County, Oregon, be and the same hereby is, proposed and referred for submission to the legal voters of said City at a special election hereby called and to be held on the 3rd day of November, Resolution - 1 .,: . 1, :' 1970, which Charter amendment, to be so referred, is as follows: CHARTER AMENDMENT REFERRED TO THE VOTERS BY THE MAYOR AND COMMON COUNCIL AN ACT To amend and revise the 1889 Charter as amended of the City of Ashland, Jackson County, Oregon. BE IT ENACTED BY THE PEOPLE OF THE CITY OF ASHLAND, OREGON: Sect ion 1. That Article XIII, Sections 2 and 3 of the 1889 Charter of the City of Ashland, as amended, be, and the same hereby is amended to read as follows: ARTICLE XIII ~ Appointive Officers Section 2. Qualifications, Duties and Salaries. The council shall by ordinance prescribe the duties of appointive officers, and determine their compensation and qualifications, excep~ that the municipal judge shall be a member of the Oregon State Bar, provided, however, that all appointive officers must be residents of the city of Ashland or become residents upon their appointment. Sectton 3. Removal. The Mayor may suspend until hearing before the council any appointed officer at any time, provided further, however, that any appointive officer may be removed by the Common Council at any time after a full hearing before them. Sect i on 2. That the Recorder, W. E. Bartelt, shall appoint and certify an election board which shall act as a counting board in each . precinct. That the election board certified by the county clerk shall serve as the election board during the time the polls are open. That the respective polling places lawfully designated for the said general election held on the same day at the same time are hereby designated as the polling places for the special general election. Polls will be open from 8 a.m. to 8 p.m. Pacific Standard Time on November 3, 1970 for said special election. Sect i on 3. That the City Recorder is hereby requested and directed to give due notic.e of, such special election herein called as provided in the Charter and Ordinances of the City of Ashland, Oregon; that is to, say, notice of the call ing of said election, the time and places for voting and the ballot title shall be pub- I ished in the Dai Iy Tidings', a'newspape'r of general circulation printed and published in said city, at least once ten days prior to the date fixed h'ere.in for holding '~aideiecti'on. .Se~tion 5. -. ! That inasmuch as it is necessary that the proposed Charter amendment to voted on at the general election in order to save expense to the City, it is hereby deemed necessary for the peace, health, safety and general welfare of the citizens of the City of Ashland th~t an emergency be, and the same is hereby declared to exist, and this resolution shall be in' full force and effect from and after its adoption by the Counci I and approval by the Mayor.
