RESOLUTION 7,?) -6lP A resolution proposing an amendment to the 1889 Charter of the City of Ashiand, Jackson County, Oregon, as amended by the various char.ter amendments to date. Further providing that said proposed charter amendmenti be submitted to the electors of the City of . Ashland under a ballot' title herein set forth for their approval or rejection at a special election hereby called and to be held on the 3rd day of November; 1970,and declaring an emergency. WHEREAS, .there is a specia1.e1ection called for by the Common Council of the City of Ashland in March of 1970 to amend the charter of the City of Ashland, and WHEREAS, the voters passed the.proposed amendment to the charter, and WHEREAS,. the amendments of 1970 combined the job of Recorder and Treasurer but did not clearly define his duties, NOW, THEREFORE, BE IT RESOLVED that the Mayor and Common tounci 1 o~ the City of Ashland: Section 1. That. amendments to the Charter of the Ci ty of Ashland, Jackson County, Oregon, be'and the same hereby is, proposed and referred for submission to. the legal. voters of said City at a special election hereby called and to be he1d'on the 3rd day of November, 1970, which"Charter amendment, to be 59 referred,' is as follows: CHARTER.AMENDMENT REFERRED TO THE VOTERS BY THE MAYOR AND COMMON COUNCIL AN ACT To amend and revise the 1889 Charter as'amended of the City of Ashland, Jackson County, Oregon. BE 'IT ENACTED BY THE PEOPLE OF THE CITY ,OF ASHLAND, OREGON: Section 1. That Article VI of the 1889 Charter of the City of Ashland, as amended, be, and the same hereby is amended to read as follows: 1'_" , ,.. Resolution -1- . c. , '. f".. AR!ICLE VI - Recorder Section 1. Term. The recorder in office at the time this charter takes effect sha 11 continue in offi ce unti 1 the end of hi s term of office as fixed by the charter.of the city in effect at the time this charter is adopted. At the biennial general election held in 1970 and every fourth year thereafter, a recorder shall be elected for a term of four years. Section 2. Powers and Duties. The Recorder shall act as Clerk of the Counci 1 and shall keep plain and correct records of all business and proceedings of the council. He shall maintain a file of all papers 'presentedto him officially, and safely keep all files, records and papers of the corporation pertaining to his office, and these shall be open to the public. At the expi- ration of his term of office, he shall turn over to his successor any and,a11 records; books and papers pertaining to said office. The Recorder must draw all orders for the proper payment of monies against the proper funds that have been appropriated by the city council, and together with the Mayor, sign the same. He . shall supervise the city accounting records and shall make periodic audits of them. The recorder shall, as soon as the counci 1 shall make a general levy of the taxes for the city, certify the same, together with any and all special benefits and assess~ents then duei to the Clerk of the County Cour,t.' He shall cancel forthwi th a 11 orders when pai d', and sha 11 keep a cor rect account of any and all receipts and disbursements, and'all times keep his account books open.to the inspection of the council, and at the expiration of his term of office he shall turn over to his successor any and all moneys, books ahd papers pert~ining to his said office. 'He shall, upon receipt' of any sum or sums of money, credit the amount received to the proper fund or funds, and shall not under any ci rcums tanc'es app 1 y any spec i a 1 fund to other purposes. He shall receive all moneys due to the city from the county treasurer, ahd all other moneys offered him for the city, and shall annually by the first meeting in December of each year, and at such other times as the counci 1 may request, make a full arid written statement to.the counci 1 of the condition of the financial affairs of the city, and perform such other duties as may be imposed upon him by the council. In the Recorder's absence, the Mayor shall appoint a clerk of the council pro tem who, whi Ie acting in that capacity, shall have all the authority and duties of the Recorder. Section 2. ., That the Recorder, W. E. Bartel t, slia 11 appoint and certify an election board which shall act as a counting board in each precinct. That. the election board certified by the county clerk shall serve as the election board during the time the polls are. open. That the ballot title of said measure so submitted to the electors at such special general election herein ca1 led shall be as fo 11 ow s : ASHLAND CHARTER REVISIQN - .Referredto the People by the Mayor and Counci 1. Purpose: To amend the Article VI of the 1889 Charter of the City of Ashland, as amended, by defining the Yes duties of the City Recorder. No Section 4. That the Ci ty Recorder is hereby requested and di rected to give due notice of such special election herein cal led as provided in the Charter and Ordinances of the City of Ashland, Oregon; that is to say, notice of the ~a11ing of said election, the time and places for voting arid the ballot title shall be published in the Daily Tidings, a newspaper of general circulation printed and published in said city, at least once ten days prior to the date ~ixed herein for holding said election. Section 5. That inasmuch ai it is necessary that the proposed Charter amendment be voted on at the general election in order to save expense to the City, it is hereby deemed necessary for the peace, health, safety and general we1fare:af .the citizens of the City of Ashland that an emergency be, and the same is hereby declared to exist, and this resolution shall be in full force and effect from and after its adoption by the Council and approval by the Mayor. .Resolution -3- " . ... ,. .
