HomeMy WebLinkAbout1916 Regulations to Water Emergencies Repealed by 2678 p / ORDINANCE NO. / I� AN ORDINANCE ESTABLISHING REGULATIONS RELATIVE TO WATER CRISIS EMERGENCIES AND DECLARING AN EMERGENCY. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION ,1 . WATER CRISIS EMERGENCY. At .any regular or special meeting of the City Council, the Mayor, with the consent of a majority of the Council; may . declare a water crisis state of emergency if, in the opinion of the mayor and a majority of the Council, the adequacy of the water supply for the City of Ashland is sufficiently endangered to create a risk of danger to the health, safety and welfare of the people of the City of Ashland'. Any declaration of a water crisis state of emergency shall be in writing, subscribed by the Mayor and City. Recorder, and shall state the effective date and time of such declaration SECTION 2 . PROHIBITED ACTS DURING WATER CRISIS EMERGENCY . During a water crisis state of emergency, it shall be unlawful for any person to commit or engage in :any of the followingx acts: a . To use water to wash any building, house,' garage, . or other structure or part thereof. -.. b. To use water to wash any car, truck or other vehicle, except at a commercial business establishment. ., c . To use water to moisten any driveway, sidewalk, street, alley or other uncultivated surface of real .property. d. To add water to any swimming pool except at a commercial business establishment. e. To use water in any air conditioner or air cooling mechanism,• except at a commercial business establishment. Violation of this section shall be a misdemeanor punishable by 'a fine not to exceed $500 and/or "Imprisonment for a period not to exceed 30 days . .. J -1- .Ordinance No' RONALD L. OREGON 97520` � ? _"�'• r+n . >S. s_ SECTION 3 : EMERGENCY POWERS OF MAYOR DURING WATER ' CRISIS EMERGENCY 1 During a water crisis state of emergency the mayor shall : J a. Impose a rate schedule for the purchase of water supplied by the City of Ashland, with higher rates for higher use Such rate, schedule shall be in writing, subscribed by the Mayor and City Recorder, and state the effective time and date of such rate schedule. b-. Impose such other water-saving measures upon the City of Ashland, as, in the opinion of the Mayor, . are reasonable and necessary to protect the health, safety and welfare of the people of the City of Ashland. Any such measures shall be in writing, subscribed by the Mayor and City Recorder, and state the effective time and date of such measure . The willful violation of any such measure shall be_ a misdemeanor punishable . by a fine not to exceed $500 or imprisonment not to exceed 30 days. SECTION 4: TERMINATION OR SUSPENSION' OF STATE OF EMERGENCY ,, a . At` 'any general' or special meeting of t he City Council, the_Mayor`, with the consent of a majority of the Council,' or a majority of the Council, , may declare the termination or suspension of'a water crisis state of emergency. Any declaration, -- of 'a termination or suspension of a water crisis state of emer_- gency shall be in writing, subscribed by the Mayor ''and City Recorder, and shall state the. effective date and time of such declaration.. . M CTION . 5 . SAVINGS CLAUSE Should any part of this ordinance be found to be invalid for any reason, then such part of this ordinance shallr be void, and the balance of this ordinance shall remain in full . force and effect.. SECTION 6 .. OREv ON 9'l$2❑ MAYOR'S PROCLAMATION A PROCLAMATION BY THE MAYOR OF THE CITY OF ASHLAND, IMPLEMENTING AN EMERGENCY WATER RATE SCHEDULE PUR- SUANT TO ASHLAND ORDINANCE NO. 1916. WHEREAS, Ashland Ordinance No. 1916 requires the Mayor to impose a rate sched- ule for the purchase of water with higher rates for higher use during a water crisis emergency; and WHEREAS, the following rate 6.chedule is hereby adopted to insure an adequate water supply; to establish a method for the implementation of said rates; and to establish penalties for excessive water use. NOW THEREFORE I, GARY L. PRICYETT, MAYOR OF THE CITY OF ASHLAND, OREGON, DO HEREBY PROCLAIM AS FOLLOWS: SECTION 1. For every cu.ft. of water consumed thereafter, the pen- alty shall be $.025 per cu.ft. A second violati.on shall result in the- same penalty as above, and the installation of a flow-restricting device ' for a thirty (30) day period. SECTION 2. Commercial water service rates for multiple-family residential or mobile home parks within the city limits shall be as follows: ` Meter Size Min. Excess, but not exceeding maximum allocation set forth below .0120 per cu.ft. . Penalty. The maximum allocation to a multiple family complex or mobile home park shall be 2,000 cu.ft. for the first unit, plus 600 cu.ft. for each additional dwelling unit. For every cu.ft. of water used thereafter, the penalty shall be $.03 per cu.ft. A second violation shall result in the same penalty and the installation of a flow-restricting device for a thirty (30) day period. SECTION 3. The maximum allocation to a commercial account shall be eighty five percent (85%) of average monthly water use during the months of June i through September 1976, inclusive. For every cubic foot of water used thereafter, the penalty shall be $.03 per cu.ft. A second violation shall I result in the same: penalty and prosecution in the Ashland Municipal Court as set forth in Section 3 of Ashland Ordinance No. 1916. SECTION 4. Water service rates outside the city limits shall be one and one quarter (1725), times the inside city rates in each of the respective categories above. i .
