AN ORDINANCE OF THE CITY OF ASHLAND WITHDRAWING CERTAIN
RECENTLY ANNEXED REAL PROPERTY FROM JACKSON COUNTY FIRE
DISTRICT NO. 5 (Shapiro Annexation)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS :
SECTION 1. The following described real property situated in the City of
s1A lap ,-7ackson County, Oregon, is hereby withdrawn from Jackson County
Fire District No. 5 pursuant to the provisions of ORS 222.524. Said real
property is described as follows , to-wit :
Commencing at the quarter section corner common to Sections ll and 14, Township
39 South, Range 1 East of the Willamette Base and Meridian, Jackson County,
Oregon; thence North 89 054'06" West along the section line. common to said
sections, 674.53 feet to the intersection with the centerline of Tolman- Creek
Road, as said road has been resurveyed and monumented; thence leaving said
section line, North 00 004'09" East along the centerline of said road as -hereto-
fore set forth, 1325.05 feet; thence leaving said centerline, North 89 009' 19"
West, 30.00 feet to a 5/8 x 30 inch iron pin situated in the Westerly right
of way of Tolman Creek Road for the True Point of Beginning; thence continuing
North 89 009'19" West, 289.69 feet to a 5/8 ,x 30 inch iron pin; thence
South 05 054'53" West, 3.10 feet to a found 5/8 inch iron pin situated at
the North-Northeast corner of that tract or parcel of land as set forth in
City of Ashland Ordinance No. 2109; thence North 89°31 '.33" West along the
present city limits line, as set forth in the hereinabove referred to ordinance,
340.84 feet to a found 5/8 inch iron pin; thence leaving said city limits line,
North 00°07'22" East, 448.44 feet to a found 3/4 inch iron pipe; thence
South 89 028'54" East, 249.88 feet to a found 112 inch galvanized iron pipe;
thence continuing South 89°28'54" East, 380.53 feet to a 5/8 x 30 inch iron
pin situated in the Westerly right of way of Tolman Creek Road, as said road
has been resurveyed and shown on Recorded Survey No. 5613; thence South 00°04'09"
West along said Westerly. right of way, 446.74 feet to the point of beginning.
Containing 6.474 Acres, more or less. =
Subject to any and/or easements and/or rights of way of record and those
apparent on the land.
SECTION 2. The Citv of Ashland elects , Pursuant to ORS 222 .520(2) , to pay
annual, as the bonds of Jackson County Fire District No. 5 that were out-
standing on the effective date of this Ordinance , as the same proportion of
such outstanding bonds and interest thereon, as the assessed valuation of
that part withdrawn bears to the assessed valuation of the entire district
on the effective date of this ordinance .
The foregoing ordinance was first read on the 7th day of February , 1984 ,
and duly PASSED and ADOPTED this 21st day of February , 1984.
