AN ORDINANCE AMENDING CHAPTER 4. 16 OF THE
ASHLAND MUNICIPAL CODE WITH RESPECT TO
ANNEXATION CHARGES .
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS :
SECTION 1 . Chapter 4. 16 of the Ashland Municipal Code shall be amended in
its tentirety and shall read as follows :
"Chapter '4. 16
SYSTEMS DEVELOPMENT ANNEXATION CHARGES
Sections :
4. 16 . 010 Systems Development Annexation Charge -- Imposed
4. 16 . 020 Systems Development Annexation Charge -- When Payable
4. 16 .030 Systems Development Annexation Charge -- Disposition of Funds
4. 16 . 040 Systems Development .Annexation Charge -- Scope
4. 16 .010 S stems Develo merit Annexation Char e --' Im osed. Upon the
annexation o an of er t an pu is an s , streets , roa s and railroad
rights-of-way to the City of Ashland, a Systems Development Annexation
Charge shall be levied on such land, which charge shall be a lien on the
land until paid in full . The purpose of such charges are to , in part ,
compensate the taxpayers of the City of Ashland for their investment in
public facilities and systems and to generate funds for the expansion
of such facilities . The charges shall be as follows :
A. Low Density Residential : $ . 0192 per sq. ft .
B . Single Family Residential : $ .0383 per sq. ft .
C. Suburban Residential : $ .0573 per sq. ft .
D. Multiple-family Residential : $.0601 per sq. ft .
E. Commercial : $ .0876 per sq . ft .
F. Employment : $ .0571 per sq . ft.
G. Industrial : $ . 0442 per sq . ft .
4. 16 .020 S stems Develo' ment Annexation Charge bdhen Payable . The Systems
eve opment nnexation charge shall e ue an paya le upon, and concurrently
with, the issuance of a valid building permit ; or the issuance of a valid
permit for a connection to the sewer or water system; or upon the issuance
of a Zoning Permit pursuant to Section 18 . 112.010, whi-c' ever of the fore-
going occurs first . Collection of such charges shall be as set forth in
Section 4. 20 . 040 of this Title .
4.16 .030 S stems Develo meet Annexation Charge -- Disposition of Funds . All
funds erive rom t e Systems Development Annexation Charges are to be
segregated by accounting practices and placed in the Capital Improvement Fund
or appropriate debt service fund to the City , and shall be used solely for
Capital improvements .
4. 16 . 040 Systems Development Annexation Charge -- Scope . The Systems Devel-
opmentAnnexation arge� s provideed in this Chapter are separate from and in
addition to any other applicable tax, assessment , charge or fee otherwise
provided by law. "
